how do you apply for it? can i do it now? or do we need to wait to file taxes?

You just ask the company you closed with...they should have told you about it at your contract signing. I would call the mortgage company or bank and they can help you

I think you can just amend your 2009 tax return and you're good to go. They will need to see a copy of the HUD-1 with all signatures.
