Building Variances (Town of Hempstead)

Building Variances (Town of Hempstead)

Does anyone have any experience with these? I'm so frustrated / annoyed / sad right now. We want to have things done to our property (which has taken us a while to get, but that's another vent...) and now we were told that it will take a year to get a variance for it all. I'm so, ugh, I don't even have words...disheartened...

I was just wondering if anyone has had to go through this, and maybe has some advice or hopeful words!

Thanks!!

Be prepared to wait and wait....and wait.

We put a second floor on my DH's house. His mom lives downstairs. The construction is done, but we are still waiting for the application to get final approval.

Over a year ago, we applied for a Mother/Daughter variance to put in a kitchen. We FINALLY got the building permit on Friday. So, now we can proceed with the kitchen. We have already picked out the cabinets, but couldn't order them until we got the permit.

If you don't mind me asking, how did you do the construction without the approval?

I'm just so frustrated right now...we had to wait because we were buying a piece of county owned land that is attached to our property - that took 7 months...and no one has any idea why...and now, we're going to have to wait who knows how long to do anything on it. I wish I knew what the consequences were of doing it beforehand...

We haven't gotten final approval and Certificate of Occupancy (I think that is what it is called).

You have to show that all the work was done correctly and according to code.

What kind of Variances are are you seeking? ie, setbacks, floor area, existing non-conforming site? Did you go for a hearing yet or are you scheduled for one?

That's it?! A pool is taking this long? Do you have an architect?

The problem is that part of the pool would come in front of the back corner of the foundation...

We haven't decided on one yet, but probably soon...I'm just so annoyed with everything...

Re: Building Variances (Town of Hempstead)

we did a huge rennovation, we had an architect, he filed the papers to the town of oyster bay in sept of 2006 and we got approved in march 2007
I also had to go around to all my neighbors in a 200 foot radius and show them the plans and get them to sign a consent form!

So it takes a long time, but people are not really building right now and i know that the town of oyster bay had 50% less permits issued in 2007 the year we got approved so it may of taken even longer than that

Do you need neighbor's signatures in all areas? That will be some job for me to do over the weekend! lol

it wasn't required but our architect urged us to do this, he drew up the form for them to sign, and gave us extra plans to show them. Most neighbors invited me in, and were so nice and wanted to see the plans in detail

It was good to have when we went for our hearing to show that all our neighbors were on board for the project.

Do you live in a village? My ILs didn't have to go through the town but through the village.

Putting in a pool is cake and just needs a $25 permit.

You need to get a variance for ARTICLE XXV § 252- A1.
Your swimming pool must be located in the rear yard.

I suggest you hire an architect to represent you.

Re: Building Variances (Town of Hempstead)

Do you know what zoning district you're in? Your pool cannot occupy more than forty percent (40%) of the area of the rear yard. What is your side yard setback? Is that the only variance that you're seeking.

Go to this website, click Property Search, select Accept on the bottom of the page. Type in your address and it will tell you what zoning district you're in.

I'll have to find out the zoning district...

This whole rear / side yard is the problem. Let's see if I can explain this quickly (I have a really bad drawing I made on excel, but I don't think anyone wants to see that!) But, basically, we want to put the pool in the back corner of the yard - so it wouldn't completely be in the rear yard (there is only about 30 feet between the back of our house and the end of the property, and we didn't really want to build a slide from the house into the pool...) soooo...while it would start behind the line that would be the back of the house, part of it would come in front of the back of the house...I'm sure we could figure out a way to fit it in the back, but then the other things we want to do wouldn't completely work. I'm just being stubborn, and getting frustrated with it all. I was really hoping it would be done this summer, and, I might get yelled at my people for this, part of that reason is cause I was really hoping to have one summer to enjoy it all without kids (which I KNOW sounds selfish and silly...)

Who knows - maybe things will work out...But, if not, maybe we can atleast build the deck off of the back of the house that we want to do, so that we can do a little bit of hanging out in the backyard...

Thanks ladies - for listening to me vent and for the help!!!!
