fender bender/insurance claim question...

hey guys - i have (thankfully!) never been in this situation, but i'm curious as to what is supposed to happen...

BIL got into a minor fender bender couple weeks ago...from what i understand, it was a 4 way stop and he had the right of way, but a girl hit him. he reported it to his insurance, so did she.

BIL is now getting calls from the girl's insurance agent saying that he won't be entitled to any money because the fender bender was his fault.

ummm what? how does this entire insurance thing work? what should happen? any info would be appreciated!

tell him to call a lawyer.

I personally have had very bad experiences dealing with insurance adjusters/claim people in the past (no offense to anyone in that area) and I found that once I get a lawyer, things are much easier and go much quicker.

Have him call his insurance company-he doesnt need to get another lawyer if his Insurance has one, tell them that she is disputing fault for the accident. Also, did they fill out a report? If so-there should be a box naming who was at fault. Check this and see what it says....if it says 50/50 that is why they arent going to pay out to your brother.

Definitely call the insurance company-they will take it up with her insurance company.

I would agree with the above poster to have him call his insurance company. That is why you have insurance. They will fight it out.

Okay i just had this happen to me but luckily the woman said it was her fault

when i called Geico about it she hadnt called yet and we were told that if she claimed it WASNT her fault that they would have to send someone to investigate what happened BUT if we had a police report ( which we didnt ) that the police report was the only evidence needed.
