Is Shutterfly legal?

Is Shutterfly legal?

This might seem stupid but I am getting the last of my proofs this weekend and I can't help but wonder, firstly, how do you get them on Shutterfly (by scanning your proofs) and second, is it legal for shutterfly to re-print them?

I ordered some pics and I just got them and they came out GREAT!!

Please help the computer illiterate.

THANKS

Re: Is Shutterfly legal?

It is against copyright laws to even show our photos on the net without the permission of your photographer but most photographers dont mind since its good word of mouth for them.

Having shutterfly reproduce them is definitely against copyright laws. There is a copyright policy on their site.

Thanks Stef. I am going to go to their home page and check it out.

Seems that everyone uploaded their proofs to shutterfly and the lawyer in me got to thinking........

Rachel, I wondered that too after reading it but I ordered proofs from them
after all, they process the order and can tell its a photographers proof since the little number is in the corner

My photog puts their copyright on the back!!!
I am getting the digital proofs from the photographer this weekend and I was wondering if I could re-print them nice without him

Re: Is Shutterfly legal?

RL: Do you own the copyright for the photos? Some digital photographers are giving their clients the ownership of the photos in addition to the proofs. If you own them, you can do whatever you like with them.

Also - im not entirely sure but pretty much so - if you print them YOURSELF (using a home printer), I think its legal to reproduce them b/c you are not doing so for profit. Whereas shutterfly is selling them to you, they are violating the laws.

Maybe you can clarify that law for me if Im wrong.

Re: Is Shutterfly legal?

I wish I could Stef but I am just a defense attorney

My photographer won't give me the proofs on disc because 'then why would you need us?' So he is obviously not going to give me the copyright.

But like you said, and what people do everyday, is scan and print their own pics. But the quality is not as good. I am just trying to be cheap and not give my photographer more money I guess.

Imagine gave me all rights to our negatives and our proofs so we can do what we want with them.
