Am I entitled to Vacation Pay? help please!

Am I entitled to Vacation Pay? help please!
I worked in my library for a year and after a year you are entitled to a vacation. I am leaving though this Monday, so no chance to actually take the vacation. Should I be entitled to vacation pay?

It might depend on the Library policy. But, I think they have to pay you for vacation time earned. I think it is a law. I would ask.

Usually if you are leaving before you take advantage of your entitled time off they pay you for it, just as if you took the time before you wearned it, they would deduct that amount from your pay.
It never hurts to ask HR though

I actually did, this is why I want your opinion on itThey said since I didn't take a vacation before I left, I wouldn't be entitled to the pay but she would have to ask the director and PT people don't always get their benefits. Makes no sense!!!

hmmmm, I might check out the NYS Labor Board's website then....that sounds a little off.......I am not sure if it is law or just common practice though.

n addition to any other penalty or punishment otherwise prescribed by law, any employer who is party to an agreement to pay or provide benefits or wage supplements to employees or to a third party or fund for the benefit of employees and who fails, neglects or refuses to pay the amount or amounts necessary to provide such benefits or furnish such supplements within thirty days after such payments are required to be made, shall be guilty of a misdemeanor, and upon conviction shall be punished as provided in section one hundred ninety-eight-a of this article. Where such employer is a corporation, the president, secretary, treasurer or officers exercising corresponding functions shall each be guilty of a misdemeanor.As used in this section, the term 'benefits or wage supplements' includes, but is not limited to, reimbursement for expenses; health, welfare and retirement benefits; and vacation, separation or holiday pay.
This section shall not apply to any person in a bona fide executive, administrative, or professional capacity whose earnings are in excess of six hundred dollars a week

It is a tough spot, but is the person you need the recommendation from going to be the person you may need to 'convince' that you are entitled to this pay?
Is there another superior that you have a rapport with that you can use as your referral contact?
I am pretty insistent on getting what is earned, and to make sure that the company makes good on what they owe their employees. I think that most people would let it go, though.....jmho

I think that is probably the best thing then...put it out there and see what kind of a response you get.

Do you have a union? We do and we have a policy about it. It spells all of that stuff out pretty clearly.

Our handbook says I am entitled to the vacation..nothing about pay though

If they don't give it to you...extend your last day the amount of vacation days you have left.I do believe they have to give them to you.

There is no law that forces companies to pay for vacation time not taken.My company for instance does not pay out Vacation time. Either take it or lose it... unfortunately.
