Any accountants? Tax specialists?

I still haven't received my 1099. Is this acceptable? I thought I was supposed to have it by Jan 31st according to the IRS website. My boss EVERY YEAR tells me no that her accountant says it can be in whenever. And if it is late, can you tell me who I would contact at the IRS to complain?

My dad is a CPA, and he has always told me by law they must get it to you by 1/31. I didn't get mine one year until after and I called HR of that company. I'm a teacher, so it was from a summer job.

Thanks! There is no HR dept at my job she has an outside acct who I spoke to on the phone last year and was very condescending and basically told me she knew about this b/c it was her job and she knew what she was doing. So who would I contact to report her?

I would check the Irs website and see if you see anything about the employer having a deadline of 1/31 for 1099 information. I know your company has outside accountant but who does cuts your payroll check ie ADP, Ceriden etc.... That is unacceptable

Ok I just googled this and they have to be postmarked by 1/31 not in your hands, and if not they can be fined by the IRS.

Are you talking W-2 or 1099? They are both supposed to be out to recipients by 1/31.

This year, that would be 2/2...HOWEVER, if it is a 1099 (not sure which form you are referring to due to the answers on the posts) from a brokerage account, this year I believe they are due by the end of February. Probably due to the economic situation and fall out with a lot of banks/brokerage.

If you are talking about your W-2, you can always use your last paystub to file your taxes and just submit an additional form stating such.

That accountant who said they can send it whenever, is 100% wrong!

I'm a CPA so FM if you have any other questions.

Looks like that's for 1099-B's.....found this online:

A new law, enacted last fall, changed the deadline from Jan. 31 to Feb. 15, when brokers, including brokerage firms, mutual fund companies and barter exchanges, must furnish year-end Forms 1099-B to their customers. Where a broker furnishes these forms by mail, this means that the forms must be mailed, not received by that date.

Because Feb. 15 falls on Sunday in 2009, and Monday, Feb. 16 is a federal holiday, the deadline is Feb. 17 this year. In addition, the IRS said earlier this month that for calendar-year 2008 reporting, the Feb. 17 deadline also applies to other tax information that brokers report to their customers, including such items as interest and dividends, on a combined year-end statement.

I would guess all others were still the 1/31 or rather 2/2 (due to 1/31 being a Saturday)

The dead line for furnishing recipients with 1099 this year is February 15
and BTW IRS does not really asses any late filing penalties for delinquent 1099. There is a penalty of $50, but they never charge it

What about delinquent 1099-MISC forms? FH worked for a youth orchestra last year off the books. . .or so he thought until the 1099 came in the mail on Tuesday of this week. The woman who he worked for got in touch with him on FEBRUARY 4TH for his SS# for the form, which he had no idea he was receiving. So, FH and I filed our taxes right after we got our W2s from school, and then this happened. FH called an accountant he knows (teaches this guy's daughter cello), and he said that absolutely, this woman should be fined. Needless to say, FH has to file an amended return and will wind up losing about half of the refund he just received--yeah, we're both livid.
