Any lawyers around???

Any lawyers around???

My mom had a car accident in January 2004. Vehicle damages were repaired and the insurance companies settled. She hasn't heard anything about it. Yesterday she came home & found a summons scotch taped to her door, indicating that now the other driver is suing her for personal injury and economic loss.

My question is: Isn't it too late fo him to file this? I thought that there was some type on time frame that this had to be filed within?

TIA

I believe the statue of limitations is 3 years. If your mom had insurance at the time, she should send the insurance company the Summons and they will represent her. She doesn't need to get a private lawyer.

You are absolutely 100% correct. I used to work as a paralegal for a PI firm...

No need to worry Beanie...these things happen. The insurance co. will take care of it.

So funny that this guy is suing her for PI...my brother sees him at the gym! And he always asks how my mom is doing! My brother is going to try to catch hm working out & take pics with his camera phone. But now the effing jerk probably won't go to the gym.

statue is three... someone must have whispered in her ear....
also depends on how much money she had covered for these things that someone can claim....
also, noone sues today for personal damages unless there are umbrellas..... you can't collect.

From my BM Anne who's a GREAT lawyer!

I think that they have six years to file, actually. Sorry. But the good news is, if your mom has insurance, they will defend you. Tell her to just call her insurance company and tell them about the law suit. Their lawyers should handle everything. She may have to show up to give a statement under oath, but thats really it. She will be covered. But let me know if you need anything!!
