I was in a car accident 4 yrs ago. And have scene nothing! I am getting angry at the lawyer b/c its the same song and dance when I talk to him. This proves to me to never do business with a friend. Apparently the insurance rep needs approval from his supervisor to sign off on the settled figure. Which I think is a bs story on the lawyer's part. I guess All State has no supervisors... I have done a deposition and that was I believe last summer or before than, like in the spring. Is there anything I can do now?

Re: Any Lawyers on here, specifically accidents
I know the laws have changed recently. But I wonder if my case applies or falls under the new laws. Best part is when I call the firm, there are two receptionists. One gives him the messages, the other doesn't. So when I hear the voice of the one that doesn't, I say I will call back. I have been getting her for the last week.

Not a lawyer, but I was in an accident (100% the other guys fault, he went down the highway in the wrong direction) & had severe injuries & it took almost 4 years to settle the case & I had a very reputable firm. It really does depend on who your suing. For example the insurance company I sued was small so it benefitted them to drag on my case as long as possible because they didn't have pay out(realize this company's ussually have lawyers on staff that they pay reguardless of handling your case or not). Unfortunately I don't believe there is anything you can really do to speed up the process if it the insurance company that is dragging their feet.

Well the SOL is (I think) three years in NY. So if you don't file suit until close to that, than theoretically the case can take several years to get to the inside of a courtroom. Do you know when your attorney filed suit and whether you have a trial date?

Melissa your case sounds screwed up. Why didn't you question what was written in the report when the police arrived? Or did you get taken away by ambulance?
What is SOL Becky? I am avoiding the courtroom at all costs. I don't want to go to trial. I was nervous during the deposition and there were only three people in the room besides me. The case was filed in 1999 same year of the accident. No trial date was set b/c the dumb a$$ that hit me never appeared to his depositions. He was called 3x to appear and with no show. My lawyer than filed something, can't remember now and then the case has been sitting every since.

Cw0904 SOL is an abbreviation for Statute of Limitations. You have a certain amount of time to file a claim or you can lose your right to file.

I was a paralegal for a personal injury lawyer for 5 years before coming here.. just a bit of advice.. Allstate is the WORST!! They take 99.9% of their claims to trial.. especially on a soft tissue injury.. I would/wouldn't blame your attorney.. litigating a case is entirely something dif and it can really drag out and get costly...Most personal injury lawyers try to do whatever they can to avoid trial because in the end it'll cost you.. although you're on a contingency agmt with the atty, the disbursements will be taken out of the settlement money..
