Any leasing lawyers out there???

Any leasing lawyers out there???

This nonsense with the woman across the hall from me slamming doors at 2 in the morning needs to come to an end. All I can do is complain to the super - i have not involved the police because there is nothing they can do.

I know why she's banging - the floors are weak and she can hear people walk, and the people above her have a baby, so she must be getting up in the middle of the night to tend to her. I know this because I have opened my door and heard it straight through her, along with her talking to herself about how 'effing ridiculous this is, people should be in bed at this hour'...blah blah blah. When you have a kid, night hours don't exist, am I right? I know that woman upstairs and she is a really nice quiet person and her husband is like a big teddy bear. I know they aren't making noise on purpose.

There has got to be another solution, I am losing sleep and I'm exhausted enough these days.

i'm not a lawyer but have you tried speaking to the woman? I would definitely try that so that you can at least document that you made an attempt to discuss it civilly with her before you attempt to take further action.

I'd rather not, she seems really unstable. I have talked to her back in June when it started getting more noticeable on my end, she flat out told me she slams the door in retaliation. I had told her, not to do that because then I won't know where it's coming from <-- and I was FRIENDLY about it. I never actually had a problem with her until the last Month and half.

She's home on disability and probably takes a lot of meds, and seems really wacky. After that first meeting I had with her, she'd always knock on my door and ask if I heard something, and I didn't. Plus, I don't have a pet permit for my cats and if I say something she doesn't want to hear, she can report me. I'd rather have the super deal with it and keep myself anonymous for the time being.

But the super should let her out of her lease at this point. If you have 6 different apartments complaining about her, then what is the next course of action the supervisor should take? That's what I am wondering.

I would definitely tell the super that if he doesn't take action that you are planning on contacting the police to handle the situation

I worked for a management company and we used to have to deal with all the noise complaints....my suggestion is to write a letter to the landlord being very specific with dates and times. If they don't respond to it, call up and complain. The super likely isn't the landlord, so in that instance, he would only be a messenger. Also have everyone else write letters to the landlord.

If she's unstable, I'd try not to involve the police....might irate her and cause her to slam doors all the time or do something wacky.
