ANYONE WHO KNOWS ABOUT COLLECTIONS OR COLLECTIONS LAW- HELP
Ok - short and sweet -
DH sold his car in the beginning of 11/03.
A few months ago - DH got a letter from AAA claims that said his car was in an accident and he should contact them and give them his insurance info so that he can pay the claim.
He calls Secretary of State (DMV out here) and they tell him this guy DID register the car when he bought it)
Calls AAA who tells him that the guy DID give his NAME, DRIVERS LICENSE etc. at the scene of the accident (which was in FEB of 04).
DH sends AAA a letter saying that he sold the car on X date and that he didn't own the car and that DMV concurred that the car had been sold.
He has heard NOTHING since.
Today he gets a letter from a collection agency saying that he owes $8, 499.00 for the accident and that they will be collecting it from him.
Ok - 1) he did NOT own the car, 2) he was NEVER sent a bill to inform him of any charge anyway so that he could have said HELLO I do not own the car - and sent them another letter, and 3) he is concerned because this is the time he is reviewed for his loans for his last 2 sememsters of law school and NEEDS this money or will have to drop out, and does not need this on his credit report for character part of the bar.
Any suggestions? Does anyone know if collections is governed by fed or state law or both? Anyone have any experience with this? AAA KNOWS that he didn't own the car and said the data base they looked in MUST not be up to date and if DMV says it was registered in this other guys name that he shouldn't give it another thought (this was said when he called them months ago which is WHY he sent them the letter to confirm he didn't own the car)
If they have the guy who was in the accident AND his license why are they bothering DH?
