Can I just vent about DWI laws PLEASE...

I know I have before. I know some of you know that I had a friend who was hit and killed by a drunk driver that was doing over 100 mph on Hempstead Tpke and blew a red light he died instantly while the morons walked away they went to jail for a freaking year

ANYWAY.. I read today in the paper that three convictions were made in 3 different DWI cases. One of them was a woman who hit and killed a 14 year old boy. The woman was sentenced to 2 years in jail one year for killing the little boy (MURDER and she gets a year) and the other year for leaving the scene (so she leaves the boy there dying) I just don't get it.

WHY DO THEY NOT GET LIFE THEY KILLED SOMEONE FOR CHRIST SAKE. DWI and Killing someone is only a misdemeanor.


In the other case the guy had a .13 blood level (legal limit is .08) and he killed 4 TEENAGERS He pleaded not guilty. How do you plead not guilty to that,

I know its very frustrating the laws are so much stricter in other countries but somehow in the US its not considered that big a deal I don't get it either.

Yeah, I never undertood it and still don't!

That's just awful! I do know somsone whose car was takena way from him for a DWI charge, so I guess the justice system is working at least on the prevetnion side..I agre they should get a lot more time..that's mansalughter

That law was overturned. People sued the county saying it was taking away peoples property

I 100% agree! Its murder.
My sister knows the DWI driver from last week in Huntington. I dont think he was convicted yet, but we both agree, its murder and he should get life.
My example to her was, you murder someone with a gun, usually those people get life. Whats the difference with DWI?

there has to be premeditation to kill..

I agree with you 110% I think that the punishment doesnt fit the crime AT ALL!!!!!!!!!
How many more lives have to be lost???? If you want to drink DON'T drive it is as simple as that!
The ones who are drunk and driving are never the ones who die or get hurt. It isnt fair that the innocent are the ones who die

I don't know if anyone remembers a drunk driving incident that happened Jan 2004, where a young girl hit 2 brothers and one of them died, (eastern long island). Well she only got probation because she wasn't driving wrecklessly. It was their fault they were crossing the street. ARE YOU KIDDING ME.... ....YOU TAKE A LIFE, YOU GET LIFE!!!!!!!

Maybe it's not purposeful in that you intended or wanted to kill someone, but if you're drinking and then choose to drive, it's not without any fault. The person made that decision to drive!

DH is a cop and we argue about this all the time. Whats even worse, and I hope I don't get flack for saying this, is that some cops won't even arrest a DWI, they'll make them call a relative or drive them home and load them up with stupid tickets. I completely disagree with this because a free ride home is not a deterent and the next time the idiot drives drunk he/she may kill someone and it could be ME! This is such a sore subject with me and I told DH that if I ever find out he handles a DWI that way I will loose all respect for him as a police officer and a person!!

ETA: I was all for confiscating the person's car but then some idiot fought that it was against their constitutional rights. What about taking a person's life? Is that unconstitutional? Our lawmakers seriously need to evaluate our laws.

yes they did...BUT they did not premeditate killing someone!
That is what gets you a Murder 1 charge

I think in some states the ONLY way tog et murder 1 is to kill a cop.

It's not murer, but it's mansalughter, and they sentencing should be higher. You didn't mean to kill anyone, but you DID get in the car while drunk.

FYI, the woman who got the 2 years for killing and leaving the 14 year old was on her way to another bar when the accident happened. She continued on her way.

How do you live with yourself.

The probelm isn't that you went out to drink, Ive done it. BUT Ive done it with someone who DRANK SODA the whole night so they could drive my fat arse home. Sometimes im the soda drinker. You can goto any Bar and at the pay phone they have a # for a cab company they will drive you home FOR FREE! They might send you a bill later on they might not! But either way There is a way to get home. EVERYONE knows you drink and drive you could kill someone. And imo any time someone gets in the car drunk they are setting out to kill someone. And that is how everyone should think.

When I was growing up my mother told me if you are drunk or your friends are drunk call me we will pick you up and never ask any questions (I didn't drink till I was of legal age) There were times were my friends dad dropped us off at the bar and my mom picked us up at 2 or 3 am. All of my friends now they can call me at anytime and I will pick them up. I don't care where they are.
