I'm an '09 bride asking for help for a friend of mine. She is currently booked at a Suffolk County RH but found a place that she liked better that was cheaper. She booked the old hall just over a month ago and her wedding isn't scheduled until next October (well over 6 months away).
I told her about the law that says that if she cancels a catering contract that is scheduled for over 6 months from the cancellation date, she could receive her money back. I just want to verify before she goes ahead and cancels that this is correct.
Her contract does mention that the deposit ($1000) is non-refundable however does the law override her contract? She'd rather not lose the $1000 and would stick with the old RH if she can't get her money back. Any help would be appreciated.

Re: Canceling RH
I can only speak from personal experience. I cancelled an RH in Suffolk in the past. I was refunded 90% of all payments I gave to them. They did keep $500 , but I got the rest back. I am pretty sure that the law overrides their non-refundable contract.

Re: Canceling RH
yes it does but remeber that in order to get that back if you go through the 'law' then you have to go into litigation, etc and in the end its more expensive. Most of the places should be nice enough to say that if they book the date then they will refund the full deposit back

Re: Canceling RH
Thanks everyone!
My friend and I are co-workers who work at a law firm so should it come to litigation, luckily she won't have a problem having one of the attorneys here handling her case.

Re: Canceling RH
I cancelled my first hall in 2006. I did not have to go into litigation. It was a fight but I did get my money back less $100. Good Luck to your friend.

Re: Canceling RH
You shouldn't have to litigate. Write a letter certified mail return receipt requested stating that you're canceling and pursuant to Suffolk County Law Section 237-3 B (3), you are hereby demanding your deposit back. Tell them they have 30 days from receipt of the letter to issue your refund. If not, take it to small claims court and file a complaint with the Dept of Consumer Affairs.
