Doesn't this seem illegal?

It sounds like its grandfathered in. Chances are good that a builder will pick it up and knock it down for a bigger house.

My house didn't have a CO for an extension built in 1970. We signed a waiver at closing that said we would have it cleared up in 30 days. Our lawyer told us there was no way that we'd have the whole thing taken care of in 30 days, as long as it was done before we sell it's fine.

We took possession of the house in January, hired an expeditor in February. They researched the CO and found the application and blueprints at Town hall and arranged to have electrical and building inspectors come this week to try and finish up the process.

It's done all the time. However, it will usually hold up the closing process.
