dress contract

dress contract

Hi,

A friend of mine ordered her dress at Bridal Reflections in Massapequa and put down a 50% deposit Sadly, her engagement was called off and therefore she never picked up her dress or paid the balance. Bridal Reflections called her when the dress came in but that's it-they never called again not even as the wedding date came and went. So, she figured that they were just selling it as an off the rack gown. Now three months after the wedding would have taken place, they are threatening to take her to court for the balance. Is this legal? I thought the deposit was required for this purpose-its not like they can't sell it, plus they have her 50% deposit. Does anyone have any suggestions?

TIA!

I'm not a lawyer but I would think if she never told them that the wedding was cancelled and worked something out with them, then she owes Bridal Reflections the money.

She signed a contract and I would guess whether or not the wedding happened means nothing. But again, I'm not a lawyer so I don't know. Has she checked with lawyer? She may want to.

Absolutely. Your friend owes them the balance - She failed to take care of a debt she owed. It doesn't even sound like your friend tried to make arrangements with them to work something out - she just let it go without saying anything.

They didn't have to call her to remind her at all. She should really call them and try to work something out now... or just pay for the dress, get it, and try to resell it on Ebay or somewhere. The store absolutely has a right to payment.

I would think that she owes them the balance, but then again, they owe her a dress. Even though they did not call her, it's just normal protocol for a bride to follow up with the salon as well, so I can see where the mis-communication might have been on both parts.

Was the dress altered at all, hemmed, etc...?

If not, then she can def. try selling it on her own.

Ok, my fiancee's in law school still, so he doesn't know everything but he said he thinks she's bound to pay in full, due to the contract. She needs to read it over.

I would read the contract and see what it says about the remaining balance. If it says she owes them the money then they do as already posted owe her a dress regardless of whether they sold it or not
