Here's the text from the auctions that I won (2 auctions- same items, same text)
'These are six teaspoons, in perfect condition. . They are the Chantilly pattern. 5 3/4 inches long. They have been properly stored in a silver bag and looks like as they have never been used. No monogram. I am always glad to answer any questions, provide more pictures or just chat to potential buyers. Feel free to email me. I love to combine shipping and I always work to find the cheapest way to deliver your purchase. If there is some kind of problem, we can work it out by communicating.'
Surprise: the teaspoons arrived yesterday and they are FAR FROM NEW! They were also covered in tarnish. I already polished them. These spoons have DEFINITELY been used. A LOT. But, brand new ones cost $40 each. I got all 12 of these for a total of $120. But, they are much more fragile then the ones I already have. These could EASILY get bent. UGH! They are stamped 925, but I'm not even sure if they really are silver because they are so delicate!

I would send them back too, they were not as advertised. And if the seller balks, tell him/her that you will address the issue in the feedback. I know I always check feedback carefully and I am sure many other people do too.

there was a pic, but it wasn't RIGHT UP CLOSE, but it was close enough to make them look really good. She does have 100% positive feedback. Right now, I'm trying to do some research on them. It does appear that they are geniune, but in no way are they in 'NEW' condition...

You can file a complaint aginst the seller..when I was planning my wedding..I won a bid to have a cape made for me..I paid and never heard anything..they kept stalling..finally I got really sick of their excuses and I contacted ebay and they gave me the sllers contact number..I was not happy, they sent the cape immediately. It helped to be able to get them on the phone and you can get your sellers number...call that $^%$*^ and give her HELLLLLLL!!!

Did you pay using Pay Pal? If so that will be helpful if the seller isn't.
Considering the seller has good feedback in general, I'd give the benefit of the doubt and try to come to some sort of agreement before posting negative feedback.

Don't give her negative feedback just yet. Contact her and discuss your problem and hint at giving her negative feedback and see if a refund is offered. If she refuses to correct it, then give her negative feedback. Often a seller will do a return to avoid ruining their feedback status.
