We closed a little over a week ago, and found out yesterday that our washing machine doesn't drain, and I think there is mold growing inside the unit because the water STINKS! We're going to call the lawyer tomorrow to find out if this type of thing is covered under the seller's escrow account - has anyone had to deal with this type of thing? How does it work? Anyone think we could also get the huge dead tree removed from this too? (That I'm not holding my breath on because they may not have know, but the washing machine is ridiculous!)

Re: Escrow question?
We had a problem with our washer as well. It leaked all over the laundry room and moved all over the place. The lawyer told us that since it turns on there really wasn't anything we could do. I'm not sure how true this is though. I was really upset!!

Re: Escrow question?
isnt everything supposed to be in 'working order'???
i know our lawyer specifically told us to make sure we turn the washer on to make sure it fills and drains during our walk through....

Re: Escrow question?
You will have no luck with the dead tree. Did you have a walk through? Did you turn the washer on at the walk through an determine then that it wasn't in working order? Otherwise, you're most likely out of luck.

Re: Escrow question?
Unfortunately we didn't turn the machine on during the walk-through; wish I would have now, but at the time we were thinking the previous owner always had laundry in while we were looking at the house, so didn't anticipate this problem :(

I don't think you have any recourse...unfortunately. I hope that is the only thing that is wrong. Chalk it up to a learning experience. It really sux

Re: Escrow question?
i just spoke to my attorney... she said once the keys are handed to you it is no longer the other people's problem... money is only held in escrow if you close on the house and they decide to stay an extra few days...

I would like to know why this wasn't found on inspection?
My inspector told me he checks everything... including all the appliances.

did you mean to quote me?? our inspector checked everything and we will re-check it again during our walk through... not every inspector does the same quality job though...

Re: Escrow question?
we had a problem with garbage. It was written in our contract that the seller's were to have all garbage removed. The town would not take it and it was starting to smell and it was just so yucky. We got a dumpster and crew to throw it away and got $ from what was being held in escrow. Then the lawyer released the rest. It was kind of a pain with the back & forth but it was NOT our responsibility.

Actually I was referring to the OP in this case. But yeah... check those appliances... especially anything that uses water!

Re: Escrow question?
Is it normal to check the washer and the dishwasher when you go to final walk through? I didn't think of doing that... I guess I will have to remember that!

Re: Escrow question?
While we were there for the inspection a few months ago, the previous owner was using the washing machine - I guess it had worked at that point....You really should check everything, our lawyer's office basically said there was nothing we could do at this point - it should have been caught on walk-through.

We had a similar experience. We paid for 1/2 tank of oil, but when moved in there was no oil. The gauge on the oil tank was busted so nobody knew how much was really in there. Afte some deilberation we decided to drop it. It just wasnt worth it.

I would just run it with no clothes (at least the washer)... make sure you don't see a pool of water at your feet within minutes.

Re: Escrow question?
Inspectors check for all of these things but the problem is the inspector comes to the house 2 or 3 mths before you close a lot of things can happen in 3 mths.
Our attic fan worked in our house during the inspection I didnt think anything about testing it out on our walk thur in December but once the hot weather came and it didnt work we knew we had to replace it. You have no idea on certain things and you just have to hope and pray.

Re: Escrow question?
When we did our walk through we checked pretty much everything. When we closed we suddenly had no hot water (it was fine during the walk through). Our lawyer said unfortunately there was nothing we could do. It could've happened before we closed but it just as easily could've happened right after we closed. Oh, well.
