FMLA question

Hi - Does anyone know if I can be convered under FMLA even though I work for a company that employyes about 30 people. From what I am reading, I have to be a full time employee - 40 hours a week (which I am) but that there has to be at least 50 people working for my company. Thanks for all your help. I have been on line trying to find the answer, but can't find it anywhere.

You have to be employed there over a year.

from what i understand, it must be a serious condition..not sure about company requirments but if you company did have access to it, it should be in your terms and benefits ... ask HR or manager

(2) Eligible employee

(A) In general

The term 'eligible employee' means an employee who has been employed--

(i) for at least 12 months by the employer with respect to whom leave is requested under section 2612 of this title; and

(ii) for at least 1,250 hours of service with such employer during the previous 12-month period.

(B) Exclusions

The term 'eligible employee' does not include--

(i) any Federal officer or employee covered under subchapter V of chapter 63 of Title 5; or

(ii) any employee of an employer who is employed at a worksite at which such employer employs less than 50 employees if the total number of employees employed by that employer within 75 miles of that worksite is less than 50.

You answered your own question - your company employs less then 50 people so you are not covered by FMLA.

This doesn't mean your company won't hold your job. You need to discuss your maternity leave with your supervisor and HR manager.
