For those who have apartments in their homes

For those who have apartments in their homes

Does your homeowners cover this? I'm just wondering since I think most apartments really aren't supposed to be there.

Thanks.

I have an apartment in a house, and I have my own separate Renter's Insurance Policy for our stuff.

I was really wondering about if the owner of the home if their homeowners covers if there is a problem w/a tenant. I'm wondering what the liabilities are for illegal apartments as the homeowner.

Does anyone know?

Thanks for your reply Vicky.

I would assume that if it's a legal apartment, any home insurance would either cover it or there are provisions that can be added on to cover it.

If it's illegal - I don't know. I would assume that if you had an illegal apt and you had home insurance and if there was a fire or water damage - it would not cover the contents of the illegal apt because...it's illegal.

And if I was a homeover w/ a legal apartment, I would either a) state it in a lease that I do not have to pay for insurance for my tenant & that it is their responsibility & if they don't get any and something happens, it's their problem, OR b) get it and then tack the amount of the money premiums to the rent so in effect, the tenant is paying for it themselves, but its' not in their name.

I highly doubt you would be able to get *additional* insurance for an illegal apartment, since a contract based on illegal subject matter is void. However, if you have homeowner's insurance, your stuff will be covered, regardless of where in the house it is.

In case you're not sure whether it's legal or not...if it's a basement apartment, it's illegal.

Thanks for everyone's thoughts. I won't buy a house that has an apartment. This was something I was mulling over.
