FRUSTRATION!! Cesspool issue

So with any new home deal we as buyers had a few requirements written into contract on house we are buying. One involved us paying to pump cesspool before we moved in (long story but basically we don't know how old cesspool is so this will help determine). We get a call yesterday that that clause was taken out of contract when sellers signed. My attorney claims no and my version says it is still in there too. He is all over it but still all I can do is be frustrated and attempt to laugh that literally we are having a problem with s**t right now. UGH........ Need some prayers my way ladies...last thing I need to do is have to keep looking for house. UGH!!!!!

we also had cesspool issues when we went into contract. luckily, the sellers were eager to move & agreed to pay for the removal of the cesspool and a new septic system to be installed after closing. thank god it worked out because we had the cesspool pumped three times in three months before the company could do the work!

hold tight, good luck, and let us know what happens!

Re: FRUSTRATION!! Cesspool issue UPDATED

So now they are saying our counteroffer was never agreed to - this included a bunch of agreements including the cesspool issue. Meanwhile, my attorney has no written record of any of this which would mean basically that we have no contract......UGH......so our options are to: 1) Renegotiate price of house if sellers are willing to and re-write whole new contract 2) walk away and take the loss on costs we have already incurred (title, etc.) or we can sue for this money back 3) leave things as is and let the seller's win everything and reject everything that was in our counteroffer.

UGHHHHHHHHHHHHHHHHHHHHHHHH - this STINKS!!!
