i am getting sued by someone i got in a car accident from two years ago. they hit me of course. my car was the only one to get damaged and now she is saying that it was my fault even though the insurance companies settled that it was 10% my fault and 90% her fault i got all of my money for my car and chiropratic treatments and all other doctor bills. i am just freeking out now. oh the best part is that she is claiming that she is disabled and was and will be confined to hospital and/or bed and hom for a conciderable amount of time. okay my sis goes to school with her son and she is able enought to drive him to school every day! sorry just venting i cant believe she is doing this!

You need a PI!! If you can get video of her functioning normally, that will help your case! I'll FM you the name of one who specializes in insurance and medical fraud!

when I had a minor car accident back in '99, i got served papers saying I was being sued for ....are you ready for this.......$1 million dollars!!!! as stunning as this was initially, I had to eventually laugh it off, b/c they obviously cant get blood from stone!!!! the case was of course dropped!!!

They always say $1 Million dollars. I sued ina car accident and my alwyer put a million dollars. I got MUCH MUCH MUCH less than that.

Ummmm did she just realize now that shell need to be confined to a bed for a considerable amount of time??? One would think that a person would be badly injured right after an accident, not have major side effects TWO YEARS later. Is she suing you this time, as opposed to your insurance company?? I would definitely check with a lawyer on all this.

but anyway, someone CAN have major problems months or years after a car accident that they didn't have when it happenned.

My cousin was in an accident when he was 17 and he got sued because someone died. He had absolutely nothing to do with the accident...he was just sitting at a light and got hit. The wife of the man who died sued everyone involved in the accident for 1 million dollars. I'm not sure what ever happened with the case, but he never had to pay anything. The guy who died was standing in the back of a landscaping truck that flipped in the accident. I would def see if you can get pics of her driving and out and about. It would help your case.

I had a 50/50 accident w/ an older woman. SHe lives around the block from me.
The accident was in August 2001 ---- IN December of 2004, I was served with a lawsuit.
OMG, I was so pissed. The woman is always outside gardening, playing w/ her grandkids...and she's claiming that she can't stand up or sit down for more than 5 minutes each. SHe has to alternate. BLATENT LIE.
SHe claims she was unconscious at the scene of the accident, when in fact, she was EXTREMELY alert, and calling me an f'en beyotch b/c she was going to be late for work (at the Lemon Tree. ) In fact, I used MY CELL PHONE to call her husband to let her know that she was in an accident, because she didn't have one.
I HATE LIARS.

i feel a little better i called my insurance company they said to let them take care of everything. i told them that i had proof that she is out an about. (i had my sis take a picture this morning driving) they did not see this as a big deal they are going to investigate it. i feel a little better but can i sue for emotional distress. this accident was never even my fault! even the insuance company said so!! thanks all for sharing your stories they made me feel a bit better. this really is the last thing i need.

ME. When I was 17, stupidly enough I was out driving in Astoria Queens, at 3am on a Tuesday night. I got to an intersection where I had the stop sign - I DID stop, looked, but there were cars blocking my view. I was in an 87 Volvo Sedan and this guy in one of those REALLY old Hyundai's comes flying down the street and rams into my car driver's side. My car literally rolls 3-4 times and ends up on the other end of the block, upside down. His car had minimal damage. I had to go to the hospital, but thanks to VOLVO, I had no injuries, other than a bad bruise across my shoulder from holding me upside down in the car. The guy saw that I was from Great Neck, so he thought money, money, money, and sued me for $500k for 'back injuries'. I was a bad witness because I was so young and it didn't look good that I was out so late in Queens on a school night, so instead of fighting it, the insurance company settled... for $20k. *******.

Your insurance company attorneys will handle all of this. If they think they need an investigator, they will do it. All you have to do is testify at a deposition and 99% of the time they settle these cases. Nothing comes out of your wallet.

I was sued because I tapped the back of a car that was being held together by duct tape. She saw an opportunity to sue for $500,000. I saw the woman driving the same route the next day. When we had the deposition I informed the people of this as well as both insurance agencies. It was settled but she is lucky if she got enough to cover the cost of repairs and medical expenses.

This is why we pay so much for car insurance. FRAUD. So many people make up their injuries and these jerky lawyers exaggerate them. It's just so sad that this happens. This is one of the reasons why I HATE my job so much (paralegal/secretary). I'm too honest and sincere for this crap !!
