I have to call up a supervisor at Time Warner today and wanted some good points if anyone can provide me with some. Two years ago when I moved from my parents' house, I cancelled the Road Runner service. They never offered to pick up the modem when it was cancelled like they said was customary, but just said it needed to be dropped off at a Time Warner office. My mom gave it to me to do, and it's kind of hard to get to when you only get home at 6:30 on weekdays. Well, I forgot about it. We moved to another apartment, and I don't know what happened to it.
Now, TWO YEARS later, they call and tell my mom to give it back, and if not, we have to pay $175. What?! Does this seem fair considering I did at least have it in my old apartment for the first year, and they never even sent a notice or anything at which point at least I would have had it to give back. It seems pretty unfair to wait two years to ask for an object back. And it should have been their responsbility to notify us at least within a year. Isn't there some sort of statute of limitation on something like this? Are they allowed to just expect a modem back two years later after the service was cancelled?
Give me some more arguing points if you can. Thanks.

The only statute of limitations I can think of that would apply is for breach of contract, which is 6 years in NY. What did your Roadrunner contract say? Did it provide that you were responsible for physically returning it to them?

When I moved, I cancelled my cable service and had to drop the boxes and modem off at a Time Warner office.
What if you just drop the equipment off? Will they forget about the fine??
Ooooppps, just realized that you said you can't find the modem. I dunno...I think you're liable to either return the modem or pay the fine

I am sorry, I disagree with you I think it was your responsibility to give it back. IMO it doesn't matter if they waited one week or 10 years to ask you for the money, you used it you have to return it that is how the system works. I think that it was even nice that they asked for it back and not sent a letter to a credit agency against you. Sorry just MHO

Re: Help Me! Cable Company Wants Money From Me
Well, they lowered the charge to $100.
The lady said as a courtesy, we never charged it on the monthly bill. I said that would have been better for us because then it would have been some sort of reminder! I believe that's how they should do it. They should put the charge on the regular cable bill and agree to remove it once the equipment is returned.
The thing that pisses me off is my mom didn't get a choice to have it picked up. And the woman was implying that my mom was lying.
