help quick!

does anyone know what happens when you cancel a date w/a catering hall? i know you lose your deposit, but are you obligated to pay the full contract amount?

we booked a place for our engagement party, and now we have to change the date, and the owner is being a total A@#hole and wont let us change the date w/o losing our deposit money. will he be able to sue us in small claims for cancelling the contract?

Read the contract. Does it say what consequenses are of changing it (date, time, etc.)? It should.

Is the change causing them to lose $?

Where is the party going to be at?

ahhh my mom has the contract at home (in texas) and she's at work right now.

and we just booked the place about two weeks ago, so i dont see what the big deal is in changing the date.

It does matter what the contract says & when the e-party is. I know some of my contracts say that if you cancel w/in 90 days of event you have to pay in full. So I would read the contract.

It should not be a problem, but it does matter what the contract says.

What hall is this?

Just have her fax you a copy of the contract when your Mom gets home from work. At this point, a few hours really isn't going to make a difference.

It doesn't always matter what's on a contract, people always put things that aren't legal, and expect the customer to just believe it's legit. Like 'we are not responsible for lost items.....' BS you're not responsible!

If you really want to know, contact an attorney.

They should be able to transfer your deposit to the new date, but it sounds like they are being difficult.

Wow, it's not like you're booking a different place. You're simply moving the date. Most contracts state that if they can still book the date you originally had, it will be no charge to you. As far as I know, that's if you cancel w/in 3 months, 90 days.

It's the owner you're speaking with? I know when I put down a deposit it was only $100 to hold the date. Not for nothing, if he's being this difficult, I would read your contract, and if you're not obligated to pay, I'd pick a different place!

Adding clauses to the contract that are not enforceable will not void the entire contract. They only need to refund or transfer her deposit if they are nice, but it doesn't sound like they are. they are under no obligation to. hopefully it works out!
