I AM LIVID!!!! LEGAL LADIES HELP!

So my DH's works for a company where the IT department consists of 2 people. His original manager quit 2 months ago (about 2 weeks before our wedding) They told him if they couldn't find a replacement we wouldnt be able to go on honeymoon. The didn't consider him for the position because they said he hadn't been there long enough (about a 1 year and a half at this point)

They replaced the guy and my DH had to train him. Now only 2 months after being hired this guy quits. AGAIN, they don't consider DH for the position and hire ANOTHER guy and DH has to train him too. TODAY his CFO tells him among other things that he is simply too young for the position!!! W T F ???!!! I AM PISSED!!!!

IS THIS NOT ILLEGAL??!!!

He's too young to be considered for the position but you basically having him running the department on his own and training your new hires??!!

ETA: I'm sooooo mad I can't spell!!!

this sounds like the position im in right now! My design director left and I have taken over all her responsibilities with a measy $5k raise! Then my junior designer left and I have no full-timers working for me so I am crazy busy!! I don't have as many years experience so although they don't want to hire someone senior they dont want to pay me senior pay.

wow, that's insane. it's hard to do anythng legally if your DH still wants to continue working there, but i'd just tell him to document everything in the event you want to sue in the future.

check out this website for more information

Well if they do Fire him because his too young...YES itt's illegal.

Unfortunetly, theirs nothing you can really do. You cant commence a lawsuit for that reason.

I understand why your livid, I would be too.

It is infact illegal to not hire someone or consider them a position based on their age.

There is a Federal Act to protect people from this:
http://www.eeoc.gov/facts/qanda.html

An employer cannot discriminate someone based on gender, race, age, sexual orientation, disability, etc.

I would look into this if I were you and your FH.

People really need to know their rights, and employers need to know they can possibly be faced with a lawsuit. You can contact the Department of Labor for further guidance in this matter.

I hope this helps.

And if they fire him or layoff him off because he brings light to this, I would say its retilatory .

did DH apply for the position? If he applies and they officially tell him no bc of his age then it is 100% illegal. however if it is just a verbal un-official conversation there is nothing he can do.

have him apply and get everything done officially, document it all (sending the resume, getting an interview etc) and see what happens....

Thanx for all the input ladies! It's basically a he said/ she said at the moment. Nothing documented but I still can't help feeling the way I do. My DH works soooo hard and deserves better than this. He will start looking for a new job ... anyone know of anyone in IT?

I would have him apply also. I know he is basically doing the job now, but they may be saying no because he doesn't have the year of experience they are looking for. And if DH is training them - I think the company needs to reconsider the managers they are hiring!
