Re: I NEED TO VENT
Ohh Jenna! What a PITA!!! I bet they are giving you a harder time because of who the dress is made by. When was there I got to meet her. I was standing in her dress and she really wasnt very nice at all.. she didnt even say I looked nice.... I'm guessing she didnt care about the sale...or I just really looked that bad! LOL
Anyways.... I'm sure its her who is holding everything up. Maybe you could call her assistant and you would get somewhere. I think I have her number if you want it.
Sorry hun!

Re: I NEED TO VENT
I just wanted to clarify, I'm thinking a little more clearly now. I gave a deposit, but on the bill of sale it says to hold the ticket and NOT to go into production until I came back for re measurement in the fall, I never went back and when I called them to tell them I wouldn't be getting measured again I was told that they needed something in writing from me to release the dress, I never sent anything and canceled 4 days later, so how can I go from no dress to production in Israel 4 days later, I think it's a lot of cr@p and they just want to keep my money. I wrote a LONG email to the owner of the store last night and haven't heard anything back, so I'm waiting until Friday to call again, they're so not getting rid of me that easily, I'll call the designer, I'll call the better business bureau and I'll call Shame on You! Just to get some results. They went ahead without my say so which makes the contract null and void, meaning I get my money back...I don't want to have to get into litigation with this, it's just so stressful!!!! Thanks for reading this far down...

I was going to say call the designer and complain, but it looks like you have that covered. Good luck and keep up posted.

Re: I NEED TO VENT
If the bill of sale says no production without measurement, then the should not have started the dress and you owe them no damages.
Even if the the 'contract' (i.e., bill of sale) is binding (check ALL THE LANGUAGE IN THE BILL OF SALE) then if you 'breach' the contract, there are no damages to the company.
What I mean is this:
you might have been bound by the bill of sale to buy from them, though they were not to produce the dress (one is the shop, one is the manufacturer) until measurement.
There are a couple of problems/questions:
The bill of sale might have bound you to buy from them, and the manufacturing clause (not until measure) actually protects the store if they don't deliver because you don't show
You cannot enter a contract with both the store and manufacturer, so you can't bind the manufacturer NOT to make the dress until you measure. If the store entered that contract with the manufacturer (i.e. to make the dress) but entered a contract with you not to manufacture before measurement, then the contract bound a third party (manufacturer) who was not a party to the contract.
Bottom line . . . the argument is between the store and the manufacturer, not you and the manufacturer. You should sue for your deposit back, sue the store based upon your contract, because your contract is with the store.
If I have this mixed up in any way, FM me, and I can advise if it's another way around
