I won something on ebay 3 weeks ago and have not rec'd it!

I am really ticked off. I did look at the seller's record and there are a bunch of negatives but out of over 1200 feedback posts only 12 are negative in the past 6 months. I figure that's not too bad. But I guess I was wrong since I have yet to receive my item. I'm ticked! I emailed the person 3 times, after the 2nd email asking for the tracking number she replies 'what item'. Um.......you're the seller, you figure it out.

If people are too busy to ship items then they don't have any business in selling them.

I wrote them again today saying 'do you even have this item in your possession to sell?' I want some sort of informative & definitive reply in one week or I am contacting my attorney. Ha. I don't even have an attorney and I don't think one would bother writing a letter to this person for something that cost $100. But it just makes me mad that this moron can't even reply to my e-mails.

ETA: well I should have read the faq before threatening legal action against this person. Seems that according to the FTC the seller has 30 days to ship the item to me before I actually have a legal foot to stand on. So I'll have to wait....

Did you pay via paypal? If you did you are covered via the buyer protection program up to $500. You can file a buyer complaint and the seller has to prove to paypal that they shipped the item with the USPS receipt or you will get your money back.

Don't leeve feedback until you get the item or your money back. Also after 30 days you can file a fraud complaint with ebay. There are ways to get them to listen to you. Don't worry you will work it out. I would file the paypal buyer complaint now. You can file after 10 days I think. Get the seller to wake up and know he is not dealing with someone who doesn't know what they are doing. Any questions I am here to help.

ok be sure if you are filing a complaint with paypal that you do it right away - if you wait 30 days then you cant file it - it has to be done at least 7 days and no more than 30 days after purchase - so file it now or you will be stuck.
and i agree hold back on that feedback till after paypal checks it out - you can leave feedback for up to 90 days after the origional transaction - let them have the time to find the parcel - it is up to the seller ( trust me i am an ebay seller) to prove to paypal that they didn indeed send the item or they have to issue a refund.
so dont worry - but hurry up and get over to paypal and put in that claim.
