If things werent going bad enough there was a knock on the door and...

DH answered to a guy from the landlords mortgage company who informed DH that the house is being forclosed on He gave DH a packet of papers that he had copies on that he was also dropping off to the landlord. It states the landlord has not paid the mortgage since December! He's been collecting my rent and fixing up the apartment next store for his son and neglecting my side of the house which makes no sense why fix up half the house and not pay the mortgage? This is the third time someone from the bank has been here. A few months back I caught some guy hanging out of his car taking random pics of my house and when I questioned him he told me that he was from the bank and that the landlord hasnt paid his mortgage in a while. Im sooooooo pi$$ed now because to top off my wedding fiasco I have to deal with this and tonight we have NO heat. The guy fromt he bank said that once the bank takes over then we wouldnt have to leave but I noticed that the mortgage pymt is much higher then my rent. Do you think I would have to pay a higher rent and does anyone know how long this process is? Someone told me that they have to serve you 3 times with forclosure papers?

Oh wow....i dont know what to say!

I would honestly go to a landlord tenant attorney for a free consultation and find out your rights as you have been giving rent on time, but no payment to the mortgage has been made.

Many attorneys offer free consults and i can give you the nameof one if you want - when i worked for a firm we used to refer clients to him. FM me for info!

OMG that is horrible! I am so sorry you guys are going through that. I really don't know what the course of action would be for the two of you as renters. Let us know if anything changes. Will keep you in my prayers

I was sent some good advice and although it doesnt fix my situation at least I know whats going to happen. Im telling you I just dont know wether to cry or laugh anymore. Things have been so rough for me this year that I just dont know how much more I can take. I hate this house though my landlord does nothing that he says he will and my house looks like it's falling down. I only moved in because the real estate told me that he was redoing the house and his son told us the same. That was almost three years ago and NOTHING has been done and I have to call constantly in the winter because the heat is out etc, etc. All I need in one more year here though until I graduate and DH is getting a promotion in June or July so we would be able to pay alittle more in rent without struggling. I have trouble scrapping up the rent now because Im not working so moving really wasnt an option for us. I dont know somethings got to give right?

Wow! Well it's not much but take comfort in the fact that they can't just kick you to the street. The laws in NY are in favor of the tenant...and therefore you have a bunch of time. It takes a lot for them to kick you out. I would learn more about those laws, but you won't be out on your behind. My advice is start looking for something else, but don't pick something you don't want just because you think you'll get kicked out.

Thanks everyone! I just came home and found an envelope in my mailbox addressed to me and me only with only a po box listed as return address and it has the same papers in it as what was left the other night. I tried calling the attorney and they are closed. I found out that I am listed on these papers as John & Jane Doe. Im freaking out right now.

Thanks everybody. If it's not one thing it's another in my life. I just showed DH the papers that were mailed and he's going over to talk to the landlord.
