im flipping out right now!!! im in need of NWR advice

okay so my last apartment i lived in was fine and all when i was living there tho i wasnt fond of it bc it was a basement apartment but whatever...until one day my bathroom exploded..picture this: i wake up one morning and my whole kitchen was flooded and i was like W T F then i look into the bathroom and see that it was exploded..like litteraly sh it all over the bathroom floor, toliet and shower...and the area by the door was flooded also...so the bathroom exploded and water mixed with who knows what (sorry to be gross) i guess went under the walls and into the kitchen and it was also flooded by the area by my door (foyer area i guess) we cleaned it all up ourselves and had to throw out a ton of towels, not to mention our bathmats, and an area rug bc it was ruined..he didnt even come to the apartment..he sent a plumber and thats it..the sewage backed up or something (nothing to do with us..the plumber had to go upstairs to fix it- other people rent the upstairs)

so after that i was skeeved out..i mean how do u shower and feel clean in a shower after u saw sh it in it the day before?? add that plus knowing that there is sh it im sure still under the walls because all the water and stuff came from the bathroom, under the walls into the other rooms...so we decided we wanted to get out...our 'lease' was up January 1st (this was the beginning of november)but started to look bc i wanted out(we already payed for novembers rent)..we found this new place which let us move in november but we didnt have to pay until december...i talked to the landloard and he said just give him notice which we did and he said alright well i have to charge u half a months rent bc ur leaving early and i said alright...we paid the deposit of 1800...half a months rent is 600...so i should have recieved a check of 1200 fine..tho everyone said i should have complained about the stuff that was ruined i figured i didnt want to fight...keep in mind all this is done through me bc fh ***** at calling people

now its january..ive called countless times..i said id pick up the check he said no just give me your address..i did..it never came..i called again..gave him the address again (this is all through voicemail bc he doesnt pick up when i call and only calls me during school hours when he knows im a teacher) it never came....i called AGAIN finally he said its mailed out...i get it today and its $350 W TF?!?!?!?!?!?!?! im FLIPPING out...out of 1800 i got 350?????? oh and to tope it off he makes the check out to 'Janeisis' yes my name is spelled Jenise and thats how he spelled it with NO last name...fh was like u have to call and yell..tell him taht we had an agreement for 1200 and after all the crap we lost and had to clean up we actually should get more and that if he doesnt we will go to the health department or the town and repost his as s....im almost positive that basement apartments are illegal no matter what, right? i told fh that ive made enough phone calls this one was for him...so he calls on his phone *67 it..and he picks up so brian hangs up bc he wasnt expecting it...then he called on my cell like 10mins later and shocker he lets it go to voicemail and he says all this on the message

i dont know what to do! any advice???? sorry for the long vent im just flipping bc i really need the money

Unfortunately not all basement apartments are illegal, although most of them are. I suggest you google 'my nassau property' and put in the address and see if it is registered as a 2 family.

I'm so sorry you are going through this. Did he give you an explanation as to why you were only being refunded $350? If not, just call him and ask him why. He may be blaming you guys for the damage of the toilet!!!!!!! I think you should definitely create a list of everything you lost from the damage and tally up the number.

ok ill try this..i think it is though because we write checks to his company and not him..and he wrote 1200 for early lease...oh and i forgot to mention that because we left in november but payed the whole month, he put it on craigslist right away and rented it by december 1st and the rest of the money he wrote clean up (when we cleaned up the whole apartment..it was spotless when we left)

Not sure where you live, but basement apartments are usually illegal, especially if it has only one entrance and exit (not sure if yours does). I would definitely drop a line about reporting the apartment during your next voicemail to him and maybe that would shake him up a bit. He would have to pay HEFTY fines. Also, have you thought about going to him in person? Maybe he would be less inclined to screw you if you were face to face.

yeah theres one entrance and exit..and i made fh call and he said that in the message...no call back yet..even if its not an illegal apartment..theres litterally sh it underneath the walls and im sure theres mold growing and we can call the heath department also

seriously if we dont get 1200 back im really going through this stuff and reporting him..thats such bull we never gave him an ounce of trouble and didnt complain about anything even after cleaning that stuff up..i just wanted out..one month ealrier then my lease..and he was fine about it when i said it...im so mad right now its unreal

I would ripe him a new one in court.

nope...he didnt call us back yet...we are going to call again today and let him know that if he doesnt call us back by monday and tell us whats going on that we are going to report his illegal apartment to the town
