Law question - not looking for lawer-ly advice....just steer me in the right direction please

Original post by LuvMyAlfonse

1. What rights does one have if they think they're being recorded (and don't consent to it)?

No, not by the aliens from Omicron Persei 8...

I tried searching NYS law but it got me nowhere... I looked under the privacy section but couldn't find anything. I don't know exactly where to search. Thanks.

OK, here's the sitch. WARNING, you are now entering a drama zone!

Boy A was dating Boy B. Boy B paid for vacations, dinners, expenses, etc. Boy B broke up with Boy A.

Boy B still lives with Boy A and Boy A's mother and is trying to record them saying things that he could possibly use against them. Apparently, jilted lover Boy B (even though he did the breaking up) wants to be reimbursed for dates and such!!!!

So, can Boy B record Boy A?

If he plans on taking them to court... I assume that it would be considered legal if the recording was relevant to the court case. However, if Boy B spent the money on dates (and didn't have a verbal agreement with Boy A that the money would be repaid) he could try to take Boy A to court... but, more then likely he wont get anything back.

You can't be reimbursed for money you spent when you were dating someone like dinner, gifts, etc. The only way he could get money back was if he lent him money for something and had proof of this.

especially for the fact that boy B is living in boy A's house then i dont see how he can really do it...If he does then he cant use it against them, it would get thrown out

yeah very true, well kim is the one who just finished law school so she doesn't need me backing her up...But i remember see this on ALOT of court cases on tv lol...whenever someone tried to get back money they spent on someone such as gifts or anything like that they were told they have to suck it up and you cant take back gifts or get reimbursed for dinners, vacations and so on. At the time he did it with no intention of getting anything back so he cant decide he wants the money now. The only thing is if Boy A for example said hey can you lend me the money for the trip and ill pay you back but he has to prove that boy a promised to pay him back.

Same with things he brought for him, only way is if he was lending him the money but he would need proof

hmmm i do have one idea though...HOw about if Boy B just happens to be recording something for his own purposes, and 'ACCIDENTALLY' catches them saying something.

Maybe recording like a video journal in the house and it happened to be on when they said something about him.

Or how about those small recorders, have him record something like lessons, study notes or something and then just oops he forgot it on in the LR.

Still don't know if he can use it against them.
