OK FH has a lawsuit pending. He spoke to his lawyer today and said the people want to settle for A LOT less then what the suit is for and there is a good chance that if it does go to trial it will be thrown out because the first lawyer set it up wrong!!!!!!!!!!!!
What the HELL happened??!! If it does get thrown out can he try again doing it right????
I feel so bad for him!!! He is going to be in pain for the rest of his life for something that wasnt his fault!!
OH yeah and the amount they want to settle for wont even cover his medical bills!!!!!

I am a court reporter and I do depositions for lawsuits all the time. The part that bothers me alot is his medical bills arent even going to be paid for. Was it an accident that was his fault or somebody elses? What about consulting another attorney?

the accident was the contractors fault. If we did consult another attorney, this is his 2nd attorney only because the 1st gave it to them, would that change anything? his attorney now said the first attorney set it up wrong to begin with (I dont know how though). I want to know if we can start over IF the judge throws out the case.

Most lawfirms offer a free consultation. Why not go to speak to another attorney with your paper work in hand and explain your whole situation and see what they say. It cant hurt.

Anytime!! Let me know what happens. Also, maybe you could find out exactly what the first attorney did wrong.
As far as starting from scratch, I dont know about that, but maybe if this attorney you have now isnt guiding you the right way, someone else can give you better guidance. I do know that if you want you can switch attorneys and it will be handled by the new attorney.

Hi,
Whether or not you can start over depends on a lot of factors one of which being whether the statute of limitations has run. It is hard for me to really tell you specifics since i don't really know too much about the case (how the attorney screwed up, what the claim is for etc.).
If it is a personal injury/negligence action (which it seems like it is) I would find out a good law firm and go in and see them. Almost ALL law firms that do this type of work will take the case on a contingency basis (i.e. you pay them only if you get paid). In these type of suits, the skill of the lawyer is often more important than the strength of the case so before you choose a lawyer do your research!
