Legal Advice Regarding Privacy (long)

Legal Advice Regarding Privacy (long)

Unimportant background imformation:

My boss is a complete dirtbag. I feel like I am dealing with a child at times beacsue he is so embarrassing. He has no social skills, I can't stand him. On Thursday, one of our clients (who I happen to have become very close with in the last year) stopped by the office. This is the first time I had ever met him. My manager, however, met him numerous times, but has not seen him since I have worked at my company which will be coming up on four years.

When this gentleman arrived, my manager, the jerk, introduces me to him and quickly adds, 'Wow, Fred, you have put on so much weight...(holds hand in front of his own stomach symbolizing that he has a big stomach) and waht happened? You lost all of your hair...I don't know, what happened to you?'..I was mortified. I wanted to crawl under a rock. Fred, obviously embarrassed and speechless, says, 'Thanks David what a nice thing to say to your customer...'...I, trying to lighten the situation, throw in, 'It's from all of the stress he gets dealing with our NJ office...'. Fred laughs it off. David continues..., 'No really, they say it's a sign of hapiness, prosperity...letting yourself go'. This guy just doesn't know when to quit, does he?

I am totally mortified, my client leaves and I sit there staring at my friend that works behind me...I said did you hear what he just said to him (meaning Fred)?...' Yep...

About 15 minutes later, my manager calls me. You should have seen him 4 years ago. So fit, full head of hair. Very attractive, HE looks awful. I don't know what happened to him. He looks terrible. I start to reprimand him...I am like a) he has feelings...2) He's a client 3) you embarrassed him 4) That was just plain RUDE! David's like he's a guy, he can take it. I said no, he's a human being and that wasn't very nice! David was like, you are right...I'm sorry, but he still looks terrible. ... ***hole!

5 minutes later, Fred calls. He is like do you have a minute? I say yeah...is David around? I say let me take this in the breakroom...He continues to ask me what kind of moron am I working for, he is so embarrassed...he feels bad that I am stuck there... And I know this man very welll he is very sensitive about himself.. 10 minutes in to the conversation, Fred goes, 'Let me go before I get a ticket...' I hear CLICK~someone was listening on another extension!! I knew it was probably David, so I run out of teh breakroom and he is dialing the phone. I said did you just pick up my call, he said no...Monday I had a few calls like that.
Other people started experiencing teh same thing. I find out that David has teh capability to conference in on ANY Call at ANY point in the conversation. I have been getting these all day long now. ANd then otehr people started noticing it. The last straw was today, i recieved a call on my cell at 5.00. I called back form te hoffice becasue I got stuck working late. about 10 minutes in to a very boring conversation, I hear CLICK and I see David hanging up his phone~his office is directly behind my desk... That SOB has been listening in to all of our conversations!

Now, even though it's a compnay phone, without notifying us that he is doing that, is that illegal? I need to know beacsue I already put a call in to my NJ office to complain, but I am jsut so upset. What happens if I was talking to my Dr or something?? This is so unfair.

Hm I'm not a lawyer or anything but it sounds to me like he should be notifying you of your conversations may be listened to or recorded (like in telemarketing, how they say that to you before they start talking to you....).

It is a company phone, and he is your boss, so according to your company rules he might have a right to do so... NOT THAT IT IS RIGHT, the guy sounds like a complete bast-rd.

But they could turn around and say personal calls (like to the doctor) should be made on your cell phone. But anyone who says they don't make personal calls at work is lying- we all do it!!

Could you speak to anyone in HR?

I work for a small mostly hassidic company. At one point, I was the only outsider. If I say HR, they would thik HOME Run...it's that bad.

I don't have any legal advice but that must be horrible for you every time it happens. GOOD LUCK IN YOUR JOB SEARCH !

Re: Legal Advice Regarding Privacy (long)

What kind of phone system do you have? Most systems with a digital display will alert you if someone else has picked up another line.

I'm not sure if this is or is not legal (I think it might be)...

If I were you, I'd assume that he's snooping through everything. I'd remove all personal items from your desk (that you wouldn't mind him viewing), delete personal emails from your office email account, remove any personal data files from your computer and wipe your internet browser history clean.

Next step would be to find a new employer. This is horrible. There are better bosses out there!

I used to be a corporate sales exec. for Tiffany's and sometimes our managers would let us know that they would be listening to our calls intermitantlly(sp) throughout the day to asses our sales skills....whatever....

It is legal, but they should tell you that they will be monitoring calls first....at least that was the policy at Tiffany's...

He may not even have to tell you....

The best advice I can offer is to read up on your company policy ASAP!!!

Good Luck!

i'm not sure about the phone, but can't they check everything you do on the internet w/o telling you? it might be legal, but it still stinks and i'm sorry you have to deal with it.

He's such a *ick. Yes, he goes through our desks and through our PC's. I lost my keys last week and he goes I will help you look for them. I couldn't find them so I had a girl in my office drive me home. I came in the next day and my Cancum pictures were out on my desk. They were deeply buried in my drawer from when I first started. He is such a perve too. I am looking..desperately looking....

If anyone works for an Importer or Customs Broker... ???

I am aggressively looking....please let me know if you are hiring!

Hi Laurie

I work in HR and my DH works in Facility Management - and I can tell you that they have every capability of listening in on convos. I know that you definitely have to inform the person if you are being video-recorded.

Actually my boss and I were discussing whether or not that is completely legal o listen in- however, I do know that it happens all the time. I think if questioned, the person would say 'I had concerns about their performance blah blah'.

Sorry that happened.

Yes I agree. I use to work on phone systems and most manager's usually are able to do this. I don't believe he has to tell you, only if he is video taping you but I am not 100% sure. I just know in the office I was at it use to go on all the time! He sounds like he is doing it just to be a creep!

Re: Legal Advice Regarding Privacy (long)

Thank you...he really is a yucky individual...

EXAMPLE: A few months ago my co-worker walked outside to give a truck driver paperwork. She is 5'10' and turned around to go back inside when she was hit with a street sign that was hanging off of a city truck. She got a concusion.

My SOB boss informed her when she got out of the emergency room that she will jave to make up the 6 hours she missed. So with the concusion, SHE CAME BACK TO THE OFFICE!!!!

I was furious and I said to him how cruel can you be? He goes, well she is empleyed in this office. NO one told her to step outside the building to give work to a trucker. She should have insisted that he come up becasue it was not her place to be there.

I should have began to look for a new job then.

Your boss sounds like a real jerk but I think as long as you are using company property (phones, emails etc) the boss can look and listen to whatever they want.

Re: Legal Advice Regarding Privacy (long)

your boss is an ASS!! Sorry you have to deal with this crap...

but I think you have to be advised if the call is being listened to by a 3rd party..this si why when you call some credit card companies or somethig, it always says
'this may be recorded for training purposes'...they HAVE to tell you its subject to being listened to...

I am by no means a lawyer, but I think this is the situation...

Re: Legal Advice Regarding Privacy (long)

BUt if he doesn't tell me that he is on the phone, isn't that unfair? Shouldn't he has probable reason to listen in on my phonecalls?

holly231 Posted:

Re: Legal Advice Regarding Privacy (long)

I think it is unfair if you do not know he is on your call....

As far as probable reason, not sure....we have a handbook but it does not mention phone calls....do you have a handbook that you can possibly consult?? If you are curious, maybe try calling the Labor Board....explain the situation and they will give you free advice and explain any state or federal laws
