Looks like I am going to small claims court

So - this issue with my BM dresses wont be resloved any time soon....

Looks like I will be going to file a claim in Small Claims Court..... I am so angry!!!!and dont wish this on anyone!

Well here is the readers digets version...

Put a deposit on my BM gowns back in Feb of 08..774.00 to be exact... I was missing two girls that needed to be measured. No problem, the owners says we will place the order after the new year since it was so early and that would give me enough time to get the girls in.... great
Fast Forward to the last two weeks....

My sister ( he needed to get measured) was coming in from Spain, so I decided to make an appt for her....the stores # had been disconnected, website no longer existed and the store was empty!!!!

I searched the net and saw some reviews(negative at that) and one said the owner is operating under a new name.... I tried to reach the owner at the new store and have been unsuccesful since last week....now I finally get a call today from the 'previous' owner and gave her a piece of my mind.... all she says is that oh we sent a mailing...we called...NO YOU DIDN't!!! I would have gotten something!!! there were six other girls you could have reached out to as you had their info on the contracts...

I said all I want is my deposit back!!! she says well I have to talk to the new owners....blah blah and i think the dresses have been ordered...
I said that was impossible as they were to be ordered after the new year... and when I spoke to the salesgirl last week and the week before... they had no order in the system being placed...

I told her I will give her til Monday or Tuesday...if I dont have resolution..IE my money back.... I willl be in court!!!! I am not playin and not the chick to F-with!!!!!

UGHHHHHHHH!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

The responsibility is on her as a business owner to ensure that her clients have the information regarding her store~ I shoudn'y have to find out on yelp.com that she is operating under another name... I told her if you sent a mailing... and it got sent back- where is the returned postcard...??? yeah....I worked for a law firm- dont go there!!!
Voicemail- I am check it all day everyday! no other vendor has had an issue-so what makes you so special!!!

I pissed and to boot I have to start the action in Staten Island...as that is where her business's mailing address is!!! she thinks she is smart!!!She claims that the old company was merged with the new....!!! What the f#*%! ever!
