Will I have a problem getting a marriage license down here since I am not a resident of NY?
FH is a resident of NY, but technically upstate?

no...
if you're getting married in NY you have to have a NY state marriage license, doesn't matter where you're from originally.
You can get the licesnse at any town hall anywhere in NYS... no earlier than 60 days before the wedding.
