Ok, so lets say I was offered a job, and signed a contract. Then I get a phone call saying sorry you can't have the job. Do I have a leg to stand on here? I thought once a contract was signed, it was signed and the job couldn't be taken away. Any help would be appreciated!! Thanks!!

Re: Need some legal help!!
did they sign it too?
did it have any 'subjectivities?'?
Im not a lawyer but I know that made a difference for my job.
My offer of employment that I signed specifically said something like subject to background check, reference verification, credit check and final decision of the immediate supervisor.
They also told me NOT to turn in my two week notice at my old job until EVERYTHING when through.

I'm not a lawyer yet, but I'm taking the bar in July and have specialized my classes around employment law - usually, in this day and age, most employment is considered 'at will' so the employee and employer can freely revoke/quit for virtually any reason, unless it violates a statute (i.e. race discrimination). If you signed a contract, whose wording is binding on your employer, you definitely have more of a leg to stand on because they breached the contract. But, read the contract carefully - make sure there isn't any language saying that they can freely revoke for any reason at any time. If so, you don't have a case... also, even if they did breach the contract, your damages may be limited... courts usually require that the employee make a good faith effort to find employment elsewhere and are usually unwilling to grant more than the difference in your current salary and prospective salary, for just a few months...
Hope that helps...

I'm an attorney, and there's far too little info in your post to really answer properly. There are quite a few variables that are missing.

Re: Need some legal help!!
Ok, well I was recently forced to resign from my present position in my school district. In april, I filed an application to teach summer school. I recieved a letter offering me the position and it gave all the salary info and dates of employment. Then at the bottom was the part that said either I accept or decline. I checked the accept box, signed the contract, dated it and sent it back. Today I got a phone call telling me I can not have the job because I resigned from my other job. But the two have nothing to do with each other. They are two different contracts and two different positions. When I resigned, I resigned for one position and I clearly stated that, for the very reason of applying for the other. When I sent in my resignation I resigned as intervention teacher effective at the end of the academic year. This other position is for summer school and it is as a full teacher. Is this better info? Tank you so much for your help. I am going in on Monday to meet with the jerk in Human resources and I want to know if I have a good fight or waste of time. Thank you!!!
