My landlord let me know yesterday that the neighbor reported them for their illegal apt (that I live in) b/c they parked their commercial truck on the street in front of their house one night.
They told me they will let me know ahead of time when they are coming, but they have to take apart my (huge) king sized bed.
I don't get how they are going to get away w/ the full kitchen & the rest of the apt set up w/ lr/br/etc.
Has anyone been through this? Can they (housing authority) evict me?
What happens next?
In a way I'm sort of glad b/c I wanted to move sooner rather than later & this will set things in motion.

Re: Neighbors busted my landlord
I think this happened with my dad and as long as they pull the stove out that day it's not considered an apartment. But I am not 100% sure. Good luck

Re: Neighbors busted my landlord--HELP!
Bump for anyone else that may have gone through this.
The landlord told me they DON'T have to take anything out BUT the bed....
Has anyone been through this in their apt?
How many days ahead of time do they tell you they are coming?
Do they come back?
Thanks.

I have not been through this but I know that legally you cant have a stove or bathtub down there. The bed doesnt really matter because it could just be a bedroom someone sleeps in but if it has a stove or tub then the landlord could get in trouble. I dont know what will happen though

Re: Neighbors busted my landlord--HELP!
I used to rent an illegal apartment, the landlord didnt get caught but if he did, Im pretty sure the housing authority would make him gut out the entire apartment, but more importantly if this guy didnt report the rent money on his taxes he could be in alot of trouble.

Re: Neighbors busted my landlord--HELP!
It depends on the specific zoning. I know someone who has an illegal apt but all they would have to do is pull the stove out because they were zoned to be able to have a full bathroom on the basement level. You can also have a sink.

Is there an inside entrance, or only an outside entrance?

Re: Neighbors busted my landlord--HELP!
From what I've experienced when my parents used to rent, they had to remove the stove only. Bathrooms and beds, sink and even a fridge were okay, but again that can depend on the zoning laws of the region.
The town can't evict you. They would fine your landlord and tell him he either has to disassemble the apartment (which would mean you'd lose your apartment and have to move - but you'd have plenty of time) and return the house to the way it was or apply for the proper permits and pass inspections which he probably won't want to do because it will cost him tons of money in permits and his taxes will go up.

Re: Neighbors busted my landlord--HELP!
Thank you for all the info ladies. They told me they have permits for everything (bathroom, kitchen) but they have to remove the bed. They said they will put boxes & stuff around when the housing people come. This is in Queens. YET they aren't stupid, I mean I have a living room set up & a computer & pictures & my closet is full.
Also they are going to disassemble the bed but put it behind in the boiler room...so, to me it sounds kinda stupid.
To answer the Q, there is both an outside entrance & an entrance down their stairs to get to my apt.
Been away all weekend, not sure what the latest is.
Cind
Thanks for the wishes & hugs.

Re: Neighbors busted my landlord--HELP!
This happened to us a week after we moved into our old apartment! The landlord told us someone reported him. They took our kitchen cabinets and stove out for a week or so til the inspector came.

Re: Neighbors busted my landlord--HELP!
If there's a door from their house to your apartment, then isn't the nasement technically a mother-in-law apartment? That's what we have in our house and I'm pretty sure it's completely legal.

Re: Neighbors busted my landlord--HELP!
a bedroom in the basement is a violation of the fire code - it's what makes the apartment illegal. As long as there is no evidence of a 'bedroom' it should be ok.

Re: Neighbors busted my landlord--HELP!
Those are what you call nosey neighbors that don't know how to mind their own business! From what I've heard, nobody is supposed to be sleeping in basements. It's considered to be illegal. If they have permits for the bathroom, kitchen and stove, then that's fine. I'm sorry you have to go through this. Your tenants can just say that they use the basement for their computer and storage!
