NWR: Consumer Law - Returns/Cancel

Can someone please provide me with information on this?

for some reason i think its the law that if you decide to return or cancel a purchase within 3 days they have to refund your money?

I made a purchase online 5/15 - and just today realized there return policy says for store credit and not a refund. I ordered a bunch of things with the intention of returning some of them b/c i ordered different sizes etc. I just tried emailing them today to cancel (but on there website it says some of them already shipped)

Do i have any recourse here? I read there return policy and agreed to it - but i misread it It said you could return within 30 days - i missed the part that said you only get store credit.

Any advise appreciated - please help

sorry I don't know. Is there anything on the site that you would purchase using store credit?

I could - but its about $500 - i dont really want to have to spend that much. Its a site that sells bras - which should have a better return policy considering the likelihood of something not fitting.

I agree with you! It's so hard to find a bra hat fits just right. They have to expect returns!

I hate to say this, but I was always under the impression that once you buy something, the store doe s not have to take it back at all. REPUTABLE stores with good customer service- (macy's fortunoff, the gap) will offer returns but if you bought it from a small shop online, they might not care.

I worked in retail forever-most under garments are not returnable at all...this may vary depending on a store. As far as I know there is no law abotu 3 days to return, never heard of it. It goes by store policy and even if you didnt know about it or mis read it-it doesnt matter...this is my experience, i dont think there is much you can do. Sorry

I thought you had 3 days to cancel a contract (and for some reason i thought a sale is considered a contract?)

Will my credit card company offer any help? I know they ultimaley represent the buyer - so im wondering if i have a dispute with them.

I havent received the 2nd package -- so if i refuse it from DHL - does the company have to refund b/c technically i never received the merchandise?

I am not a lawyer but teach Business Law in high school. The 'cooling-off rule' as it is called only refers to sales made with door-to-door sales people or sales made away from the persons regular place of business such has hotel shows, house parties, etc. It is due to the fact that you might have felt pressure to enter into the sale. It also is only applicable for sales over $25. It does not refer to internet sales where you visited the site at your leisure and placed the order without any pressure.

Hope this helps.

PS; there is nothing to dispute with your credit company, the company did nothing wrong, you are not in a dispute. You can try to refuse the package and see if they will issue you credit because it was never received.

You cant fight it with the CC company b/c the 'return policy' is on their site. If you refuse it from DHL they may still charge you a restocking fee etc. on top-I would check their site and see what the FAQ is on doing that. I would be leery b/c you may still be charged the same amount in the end anyway.
