Ok I work at a really terrible place and we had a district manager that was disgusting and harassed me and made sexual comments to me and to other women at my job. After months of holding it in I lost it and went to the president of the company and complained and the man was forced to resign a few days later, but now everything I held in is coming out and I am having anxiety and am wondering if I have a case against the company. Any input would be great.

Re: NWR: harrasment at work
I think the only way you could sue the company is if they didn't do anything about it after you complained...

I agree. Since he was fired, I doubt that you have a case but you can always consult with a lawyer and see.

yeah, they fired him for it....if you had proof and wanted to bother with a lawyer, you might get something out of it...but honestly, you might end up fired yourself....because often the party sued is the company...and they rectified the problem by firing the harrasser....and they end up ticked at the employee costing them money even if it's legit.
ETA-kudos to you for complaining...i had a friend who was harrassed daily and refused to say anything...and now, get this, she's become addicted to the attention, only his behavior is wildly inappropriate as he is married and i've watchd him email and IM her nasty things he wants to do with her!!!

ugh it was so disgusting but everyone held it in as they were afraid of losing their job I on the other hand do not care anymore as I just could not take the abuse any longer plus I have decided to look for a new job as there are still disgusting and unethical things going on at my jobs and i cant deal with it anymore it physically makes me ill....

Re: NWR: harrasment at work
also I know for a fact that charges had been brought up againt this person in the past and nothing was done about that so the girl left so my complaint was like the second one and I really feel that the only reason they booted him was because he had a falling out with the president of the company

Re: NWR: harrasment at work
Yeah, in order to sustain a case for sexual harrassment against your you have to show that there is a hostile work environment and that your employer knows it and tolerates it. The person you can sue is the guy that was harrassing you. To make the suit worth while financially, you have to suffer some real harm and you need medical professionals to be able to atest to that fact. For instance, if you start seeing a psychiatrist and he diagnosis you with some kind of traumatic stress disorder and says that treatment will take years, then you can probably win a nice size judgment against the guy. Can he pay it, that's another question.

They couldn't fire you for filing a lawsuit -- that would be considered retaliation under Title VII and a HUGE violation of the law -- you could get tons of money if they did that to you.

Re: NWR: harrasment at work
if there were a lot of complaints to the company which they did nothing about before he was actually fired - then you may have a case
it really depends on the facts
why don't you consult a lawyer re: the specifics of your case so that they can tell you if it's worth suing over

I'm an HR Mgr and I'll tell you if they took action so quickly after your complaint you wouldn't have much of a case.

I agree...plus you would have to leave the company to sue them anyway. Since they took action, they did the best that they could do. You wouldn't really have a case against them. They did the right thing.
