NWR: I got into an accident

So i was driving along my merry way in the middle lane on 4th Ave. in Bk and out of the blue someone from the left lane drove right into my car. He says that someone from the turning lane was driving into him and therefor he drove into me....the third car left the scene & on the accidenet report the guy admitted hitting me, which is good but the whole thing just stinks...
so anyway we were right across the street form the 72nd Police Pct....Lieterally right across the street and it took them 25minutes to get there...

Anyhoo, he hit me on the drivers side ...drove right into my door and also hit my front drivers side panel...
Im FINE.. I hit my knee a bit against the driveshaft when i got hit but nothing big....and thank GOD i didnt get hit again cuz I got thrown into the right lane after I got hit and as soon as i hit the sidewalk a car flwe right by me... So i guess there was an angel watching

I am Fine.. the whole thing just stinks though!!!

Ugh, I'm so frustrated because I wrote you something yesterday in response to this and it was during that HORRIBLE thunderstorm-- so I was just about to finish and post when the electricity went out in the whole freaking house!!

Anyway, the jist of what I was trying to post: I'm so glad to hear that you are OK. You might want to get your injuries (even if they seem minor) checked out just to be safe. Make sure you keep all your medical records from your Drs visit because your Personal Injury Protection will cover that and then your Insurance company will go after the other person's Insurance to be reimbursed for that. But regardless of fault, you will be covered for your injuries under NY state's 'no fault' law which deals with injuries in an accident-- no matter who is at fault.

Now, as far as fault I just need you to tell me where the point of impact was on the OTHER vehicle. I need the initial point of impact-- where did his car hit yours? Also, you said your point of impact was your left front?? (Meaning driver's side front)... I just want to make sure. It seems as though he is 100% at fault for this. NY is a shared negligence state so there are few accidents where one person would be 100% and another would be 0%-- but this is one of them. It seems as though he did not obey simple traffic laws: a. failure to keep a proper lookout (meaning, when he went into your lane it is his responsibility as a driver to make sure no one is around and it is OK to proceed) and b. failure to maintain control over his vehicle (if this phantom vehicle that he said hit him which made him hit you is true: then he is still at fault b/c it's his 'job' as a driver to make sure a two car accident does not become a three car accident-- by keeping control. Now, if that third car had stayed they would both be sharing blame (probably 60% to40%) but b/c that left and it's just you two-- he gets all of it and you get none no matter what b/c basically, you were a sitting duck.

Now, again, I'm so glad to hear you are OK but I hope this information helped you understand the rules of the road a bit... I would call and report the accident to your company as soon as possible and make sure you report it to his-- otherwise, it could give him an opportunity to change his story. Also, obtain a copy of the police report as soon as you can for your records.

Feel free to FM me if you have any other ?s or anything I can help you with-- I used to decide liability in car accidents for a living so that's why I'm pretty used to this stuff. I can tell you what your best option is for claiming (either 1st or 3rd party) etc... So good luck, HTH!!!!!

His passenger side front light and bumber are recked!!!. he hit me on the drivers side door and the backside of the front panel (where the door hinge is!)..... They were actually very nice and took full balme when the police came. in the police report stated that he admitted to hitting me... so hopefully that will not count against me insurance wise...
How does it sound?

his right front to your left side-- totally his fault. i mean, picture that: you are just driving (and from where he is on the road) you have no clue he is even there and just comes over INTO your lane and hits you?! yeah, totally 100% his fault-- no wonder he admitted it lol... so, i would claim third party-- there is no reason why you should have to lay out a deductible just so your company can go after his to subrogate? it's ridiculous-- i would claim directly on his and have them fix it and provide you with a rental car-- his property damage should cover that-- now, the Property damage limit MINIMUM in NYS that is required is 10,000 dollars--so i'm sure that your damage is not above that (from the sound of it) so i would claim on his-- b/c he has the insurance to cover it if he has the minimum, which he may have more too... so you are in a good position. and depending on your driving record and HOW you claim, your insurance shouldn't go up-- or it should not go up much b/c your company is not laying out any money-- but if you have had several accidents like this it might increase b/c you are considered more of a risk-- but i don't think so, not in this case. HTH

well that's the tricky thing: lol, we are not having this convo and i didn't tell you to do this: but you don't have to tell your company-- the only way they might find out is if HE decides to call them but b/c of the fact that he is at fault (and seems to be admitting that) I don't think he will... so for now, I would just call his insurance company-- you can tell them your insurance info, they won't call them or anything and worse comes to worse: if your company finds out-- oh well !! lol they will call you and ask and just tell them you didn't get a chance to report it yet lol there is nothing they can do it you. again, you didn't hear this from me!

OMG Penny I just saw this! I am so happy to hear you are ok!! Accidents really do stink, but thankfully you were not hit when you got thrown into the right lane! You really do have a guardian angel watching over you because that probably would have been the worser hit!
