that's weird. he pulled him over just for not wearing a seatbealt, which he was wearing?

I think the only thing you can do is plead not guilty and then you have to go to court.

good luck

thanks for your reply.

yes, the police car drove by his left side, u-turned and just pulled him over.

i don't want to make assumptions, but we are asian, and i suspect he probably think we'll just suck it up and pay without fighting since there is no point penalty!!

FH will definitely show up in court. and he has written down his own statement of what happened so that he will have something to go with when he's in court.

but i really really want to at least file a complaint and get it on his record!!!!!
i am FUMING!!!!!

Maybe you should pay the precinct a visit and ask to speak with his boss.

You can be pulled over for no seatbelt and going to a precinct will not help.

Follow the directions on the back of the ticket for disputing it. You will have to appear in court, but so will the cop and it will be a he said he said situation.

Good luck.

The officer's badge # should be on the ticket. You can call the precint he is from a file a complaint against the officer. Usually when that happens, the officer will not show up in court and the case will get dropped becuase the officer dosent want the reputation on his record. Call the precinct, its worth a shot

CCRB

Civilian Complaint Review Board....I know that NYPD has one...so I think that suffolk and nassau would also.

This is really the only place I can think of to file a complaint against an officer

yeah, unfortunately you can and it's quite legal.

You probably need to go to court and fight it, but I'm sure the judge will be all 'why would an upstanding police officer like this do something like that' because they ALWAYS seem to take the PO's side.

DID HE HAVE IS SEAT BELT ON THE CORRECT WAY OR WAS HE WEARING UNDER HIS SHOULDER? CASUE IF HE HAD THE SEAT BELT ON BUT NOT ON THE PROPER WAY YOU CAN STILL GET A TICKET FOR NOT WEARING A SEATBELT ARE YOU ON LONG ISLAND OR THE CITY???? JUST SEND THE TICKET IN NOT GUILTY GO TO COURT AND THE JUDGE WILL MOST LIKELY THROW IT OUT. DON'T WORRY!!!!!!!! IT WILL ALL WORK OUT.

My brother was a lawyer for the CCRB, but LI does not have an equivalent bureau. I was pulled over 2 months ago for not stopping at a stop sign when I did (I maybe stopped a foot before the stop sign, so it is possible that the officer didn't see me stop because he was hiding down a side street, several car lengths before the end of the street. So I am going August 8th to court to fight it. I'm sure I will lose so it probably isn't worth the time off from work. And I am caucasian so I don't know if they do it to everyone...

Just plead not guilty and go to court. Sometimes the officer won't show up and it will be dismissed.

Same thing happened to FI also and he was 100% wearing his seatbelt. He is the type of driver who makes sure thats the first thing he does when he gets in the car. Unfortunately he didnt want to go through the hassle so he just plead guilty and paid. Im in a similar situation were a NJPD issued me a summons (not for seatbelt though) but I AM fightning this one Good luck!

thanks girls for all your responses!!!

FH is also the type of guy that really believes in seatbelts, so he have them on the right way all the time.

i hope none of us will run into a traffic police below quota again.....

Plead not guilty. Chances are the cop will not show up at court and the case will be thrown out. Good luck.

I just saw this and wanted to say sorry about what happened to your FH.

I can't justify what the cop did b/c I was not there, but I can say, not ALL cops have 'quotas'. As being an ex-cop I can vouch for that, at least with NYPD. So that MAY not have been the case.

And I will say, MANY (TOO many) cops (NYPD or other) have chips on their shoulders and ride SUPER power trips!!

Have him plead not guily and go to court. That is the best advise I can offer.

As for going to the precinct, that's your call. I think the easiest thing to do now, is plead not guilty.

Good Luck!

It's so messed up how these cops and agents get away with the things that they do. One day I had to change my car by 7am. It was 6:58am and I was walking towards my car when I see the traffic cop by my car. I look at my cell phone and see that it's not seven yet. I start to run, he sees me and jumps into the car and drives away with his partner. When I saw the ticket it said, 7:02am. I saved the cars in front of me from getting a ticket. I was sooooo mad. I couldn't afford to pay 60 dollars out of the blue for no reason. I wrote them a detailed letter and I got it dismissed. Personally, I'm the type of person that fights for what is right. If you still can't get it dismissed then atleast you know you tried. Don't give the city the statisfaction. I don't know why people don't stand up and fight againist these outragous summons.

I would plead not guilty - and hope he doesn't show - but if he does it is one persons word vs the other. Just out of curiosity - what town was he pulled?

Re: NWR - PLEASE HELP! File a Complaint Against a Traffic Police!!

Ok.... I'm going to try to help you... As most of you know, I am a NYC Police Officer. Please, Please, don't confuse us with traffic cops... Traffic cops just give out parking summonses to everyone, even the 'real' cops. They write over PBA cards, parking plaques, and any form of Law enforcement ID....

As for Police Officers, It really depends where the summons was written... I can't compare NYPD to suffolk, and nassau pd's.... What I do know is....

You CAN get pulled over for just not wearing your seatbelt. It is just a fine, and no points on your license... Some cops are ruthless and will not give you a chance to explain, but there are others that will listen.. As for pleading not guilty and going to traffic court, the city is very serious about the police officers going to court, and the cops actually get in trouble for not going. So for the NYPD it is pretty mandatory for us to be there. And if we don't show up, it will be rescheduled, not just dismissed.
I do know we have 'Goals', not quotas .... And if we don't reach our 'goals', we won't get days off and will probably be given a hard time for lack of activity.
But remember, NOT all Commands work alike... They all have different Commanding Officers, and they all do things differently.

As for Suffolk PD (Where I live) You can go to traffic court, and both the motorist and the cop, are allowed one rescheduling, then I think in the third show up, if the cop doesn't show, it's in favor for the motorist, I'm not sure what happens if the motorist doesn't show....

As for Nassau PD..... I don't have many kind words for them.... I got pulled over by a nassau highway patrol cop, and he was soooo rude when he walked up to my car, and started screaming at me for 'driving like a lunatic', when in fact I was avoiding an accident..... Even after showing my ID to the officer, not like my uniform I was wearing was hint enough, he still wanted to write me a speeding summons. No courtesy.... This happended right after the London bombong, and I was riding the subways on overtime, and after 17 hours of just overtime, I wanted to go home. And the officer was so rude, and could care less that we both did the same job....

Please remember....... EVERY Police Officer is different... Some of us are actually nice and extend courtesy to other cops and family members, I know I do..... But I can't say the same for the handful out there, that give us a bad name.... I am sorry you recieved a summons, and if you need help with what to say in court, please feel free to FM me, I'll be glad to help!!!!
