NWR: What happens when an employer files for disability on your behalf???
Any HR girls out there? Am I supposed to go this? DO they talk to my docs or get access to my medical records?? I DO NOT want that.
Can someone explain how this works?

I'm not in HR but my sister in law recently filed for disability & her company needed letters from her doctor stating why she couldn't work, when they expected her to be back at work, if she would need any special arrangements (i.e,a ramp). I don't think they get access to ALL your records. And certainly not without your permission. You would need to sign something in order for them to have any access to those.

you definitely need to sign a release form in order for them to give anyone your records.

You will usually have paperwork sent to you that you need to fill out and then will need to have your doctor fill out in order for you to qualify for the benefits. Then you send all the paperwork back in.

Yes I am sorry to say they will need doctors notes. A girl at work took a 30 disabilty leave and she had to bring in all doctor notes to show she was really sick and was getting something done to correct it.
But they do not look at your records so dont worry about that unless you say so.

i just came off short term disability last month. i was out for 6 weeks. i was sent a form that i had to fill out, have my doctor fill out (he filled out info regarding what type of surgery i had, what my limitations were, what my treatment was, and when i should be expected back to work), and then my company did the rest.

I'm on disabilty right now and it's a MAJOR P-I-T-A.
They asked for medical records from all my doctors for the past two years. I had to sign authorizations so my doctors could provide the medical information otherwise they wouldn't even review my claim.
The frustrating thing is that they've been doing this review since December and I'm probably going back to work in early May and I STILL haven't seen a drop of money.
