Okay, sooo im about ready to kill my apt complex, and i need to find a way to break the lease legally so we can rent a house and get out of this disaster.
1. a week before we move in, after runnin around on the phone, i find out that the apt that we have papers for and put money down to hold, the ppl that live there arent moving. They tell us that we have to wait a few more days to move in, we cant because out old apt complex turned into a resort n kicked everyone out....so after screaming and threats, they find us another apt.
2. Everything that we put on our move in sheet that needs to be fixed, hasnet been done yet.
3. Said our alarm was set up, went to use it, wasnt, caused us panic and made us almost miss a flight waiting for them to set it up.
4. Mast bedroom window leaks, said they were conatacting the contractor....its beel almost 2 months....
5. My vanity area window is leaking, is covered in Mildew and Mold, they left a note saying that it was condensation......
There are a few other litte things that annoy us and are redic but for now those are the big points.......Think i can get out of it for health reasons or something?? Advice thanks girls!

I suggest not paying your rent. At least until they comply to the items that were supposed to be addressed. If they aren't living up to their end of the bargin.....why should you. If the management company of the complex calls you for your rent explain to them the situation and that they will get their rent money when they fix the necessary items that need to be addressed. IDK...that's what I would do if I were in your situation.

I agree! However, if that doesnt work then post your apt on Craigs list and find someone who can take over your lease. I did it with my old apt!

Implied warranty of habitality- in every lease (even if it is not written) the landlord has to keep the premises in good condition- if it is uninhabitable you can get out

A complex I used to live in had a forfeit option and a couple of others which I don't remember. We could forfeit our security deposit if we wanted to leave which I did because the complex was absolutely horrible. Not only was there a ton of things wrong with the apartment that were not being fixed but my car was broken into. You should contact the main office and see if they have options like that

If you have provided the management with the things that need to be fixed/corrected in WRITING and they haven't fixed them, you have every right not to pay rent or to only pay a portion until the items are corrected.
I would think about having an outside company look into the mold as well. If the apartment is uninhabitable for reasons like that, you can most likely get out of the lease.

u can def get out if the apartment has mold in it.. also if u stop paying rent make sure u put the rent money into an escrow account.. so when it gets to court you can show you withheld rent.. not that u just didn't pay and spent it on something else..

I had some issues when I lived in Wisconsin with a neighbor harassing me (coming to my door and screaming at me for walking around the apartment and screaming profanity whenever I accidentally dropped something...he lived downstairs from me) and I ended up getting a lot of advice from a tenant's resource center. I'm not sure what Nassau has, but I found this: http://www.tenant.net/.
I'd suggest calling your town government and seeing if there's anyone who could help with some free advice for tenants.

thanks girls! i got the pics developed today and jon and i wrote down all the things we need to have addressed. im going to write them up and bring them down tomorrow with the pictures! i just want out! we saw a house down the road from where we are for rent so im gonna call in the am as well :)
