I just had this huge fight with our facilities manager about the exterminator thing. She tells me that the exterminator will still come every month and spray while we are here at work and to tell him not to spray by my desk. i tried explaining that they are spraying all over and we are breathing this in. She then told me that we need to have them come and they can only come during the day. Thats BS because I can get an exterminator in that will be willing to do it off hours. I then told her about the mouse poop again and she said well you have to remember that mice are little and we are bigger then them. WTH?????? Well,, I just totally went off on her about unsanitary the conditions are here and when I get sick from breathing in all this crap not only am I suing the building management, the city of new york but her too!!!!
I am writing OSHA tonite!!!! OK vent over and I need to go outside and have a cig!!!
DEFINITELY CALL OSHA!!!!! BRING THE OSHA THROWDOWN!!!!
Also...I know you are angry but I lol'd because you were talking about inhaling all that crap and then going outside for a cigarette.

Dont take this as legal advice, but here's what I would do
1. document every detail of what happened.
2. go to the doctor
3. get a physical, and have him write a report showing you are having breathing problems because of the spray
4. show the report to your workplace manager
5. report to OSHA and include all of the above
if things worsen, SUE.

yeah I know- i usually only have 2 or 3 a day better than the 3/4 a pack I used to smoke.

tonight go to walmart or target or bestbuy.. wherever and buy a voice recorder. bring it up to her AGAIN tomorrow and keep the recorder in your pocket.. get everything she says... you'll have more to stand on then just 'he said/she said'.
also, write a letter to the manager, ceo, mayor, hell even the guy who buys the bagels in the AM.. so you can prove that you've brought this matter up and nothing was done about it.

The thing is everyone knows about this and no one wants to say anything. They are all just sitting around complaining. I dont know if they are afraid or what - that is why I am trying to do something. I talked to our HR person about it and she agrees that I should call/write to OSHA, but for some reason noone want to back me up. When I write OSHA I will be CCing everyone and their mother on this.
