OMG, I am SOOOOOOOOOOOOOOO MAD, MAD IS NOT EVEN THE WORD!!!!!!!!!!!!!!!!!!

I just got a f-ing letter from our apartment complex in MA that they are KEEPING our security deposit, a lot of money I might add, because they did not receive notice that we were moving. WTF?!?!?!?!?! We TOLD them AND wrote a letter to them that we were not resigning our lease at the end of it, and they are claiming that they got the letter 5 days before we moved, not 60+ like it really was. MA has a really strict tenants bill of rights, and so I know we will get our money at some point, but I REALLY don't want this aggravation. I don't ever want to rent again!

Well, the lease states that we have to give them 60 days notice that we are not resigning our lease, ok, fine, we did that. If they want to argue that they did not receive our notice before 60 days, then that's fine because we'll be arguing that we told them October 10 that we were not resigning, then sent the letter, that's three months notice, and the lease in NO WAY states that it must be written notice.

Do you remember who you spoke with over the phone? I would fight it. Let them know exactly what you told us and that the letter was mailed. It is not your fault if they didn't open the envelope until 5 days before.

It's worth a shot!

hey rachel i would fight it. my brothers a lawyer if you want i can ask him what can be done. or if you want him to call them to shake them up. was it a check that you used as the deposit can you stop payment on the check?

JT sat and quoted the Massachusetts' Tenants' Bill of Rights to them which basically states that under no circumstances, except for damages, is a landlord to keep a deposit. Basically, you should get it back for EVERYTHING. And the woman said, 'Fine, then there were damages in that amount.' And he was like, 'Are you kidding me? I have a statement from your management company saying there were NO DAMAGES!' And then she tried a few more things and finally gave in. He was very prepared. We had the receipt from when we sent the notice of us leaving, so she couldn't try to tell us she got the letter 5 days before we moved. Asswipes!
