Re: PRE-NUP?
We are - I'm giving the FI one to protect my family's real estate, which they've placed in my name.
I'm using our personal family lawyer - Bob Tabhet.

Hewlett Harbor has one of the nation's highest income for it's population. Trust me, LI has plenty to protect.

Re: PRE-NUP?
Ive read up on them. We havent fully decided yet what we are going to do. But-if you do not have a pre-nup it is possible to lose half of everything you are worth. Usually they say that if YOU will be coming into being worth or having more then your significant other (you are going to school and will make a lot of money when you are done-parents put you in the will and it is said you are the only beneficiary) you should always protect that much. My grandmother had a pre-nup b/c her parents had a large estate, in it what she would receive from her parents was in the end HERS and in no way part of what they would share if the event occured of them splitting. You can do it with your house too. if you bought a house or condo...and youbought it for 140K and you put FH on the lease, you can get a lawyer so that when its value goes up to 240K..in the end its both of yours but he would only get 50% of the 140 it was worth when his name was put on the mortgage. Its strange...family member just went thru this...it was rough, but she still got to keep the money SHE had been putting into paying the mortgage.

Re: PRE-NUP?
That is odd b/c I thought under ny state law anything bequest to you by will can not be split b/c it is considered separate property the only way it would become your husbands/wife's is if you choose to make it joint property. I could be wrong but that is what we learned when studying for the bar. Even though it is a marital property state the only thing you wouldn't be protected from would be a degree you earned while married. Even if you get a personal injury award you would be entitled to that money upon divorce unless you made it joint property.

DH is a divorce lawyer. That for the most part is correct. But you have to be careful not to mingle the money you receive with joint funds.

Still dont quite understand them-all I know is this is what everyone told me while making it an important conversation to have with me. Telling me it was VERY important to have one b/c he could take whatever I am going to be left with.
ETA:My cousin is getting married next month and was telling us he has to cover his families assets that is why they have one-but I am in SC-but I dont see why it would be that different from NY

Re: PRE-NUP?
You have FM. By the way, in general, if in any way a spouse has an ownership interest in the family property/business, and especially if the spouse contributes to an increase in its value during the marriage, then it can become part of the marital property to split upon a divorce. Usually, however, as long as an inheritance is kept separate from joint property/funds, it remains separate property.
