my place is doing price person+20% gratuity, then they take that number and times it by the 8.625% sales tax.
Should the gratuity be included into the price when they are calculating the sales tax?? It just seems a little weird to me....

If it is a service charge it is taxable. If it is written as a gratuity it is not

Unfortunately they can do that. When my fiance looked over the contract he also noticed after all of the taxes and everything that they accidentally charged us an extra dollar per person, which adds up! We told them and they adjusted it!
