~~ QOTD 1/26/10 ~~

So this one might not go for everyone but...lets get personal!!

Has anyone had to ask FH or has FH asked you to sign a prenup? If so how did you feel? If not what would you do if he did? Would you be completely affended???

If FH asked me sign up a prenup or vise versa I would laugh b/c we would have nothing on it except our dog!!! I know a lot of people that have and some find it complete insulting! My sisters husband had her sign one. She actually wasnt upset b/c it was actually very fair~

I would laugh in his face because neither one of us of anything of extreme value that there would be a need for a prenup. I would also be kind of annoyed that he would even ask me to sign one and I would not sign it.

Nope, not signing. You cheat on me. I leave you. I take half of everything. Hopefully, the love of my life wouldn't think he needs one.

I dont see a need for a prenup when we both are going in with no assets. I would be offended because it's like you don't trust me? I would never try to take more than I am entitled to. Im not about money and you should know that.
And I dont ever plan on getting a divorce.

Now, if one of us had millions, I guess I could understand more, but it would still hurt my feelings- not going to lie.

Good question FH an I already talked about this when we were discussing his parents divorse. I told him I wouldnt want one. He totally agrees we basically wouldnt have anything on it except for our dog too!

I used to be totally against them, feeling like marriage si forever, so you can't plan for the end of it. Then my dad walked out on my mom after 35 years leaving us with ALLL the bills. I'm not sure how or if a ore-nup would have solved that, but it's changed my outlook. When that first happened I told FH i wanted a pre-nup that would put something in that if he left me I'd get huge amounts of money so I'd be taken care of. I'm pretty sure they don't actually work that way. neither of us has any money to speak of, so in real life, there's no point to a pre-nup. That having been said, if FH were wealthy and asked me a sign a pre-nup to protect his assets, I would probably call off the wedding

i wouldnt sign the pre-nup....i would ask him why he is marrying me if he thinks that we may end in divorce?

Just like most of you said, neither one of us is going into it with much and I would def laugh if the subject ever came up and I dont think either one of us would sign a prenup- except for the fact that he promised me half if he ever wins the lotto lol!!!!

hm i thought about asking FH because i have quite a lot of savings but i have no doubt we wont be getting a divorce, plus the money will be going towards our house which i feel like i would spend regardless and if we really did divorce he would realize i put the down payment down so it would be my house, i dont know i dont have any hugee fortune that i think it would cause problems if we did divorce.

I don't know if I would be upset, but FH said that he wouldn't marry me if I made him sign one (which I wasn't going to anyway).
He thinks that it means I'm thinking about divorcing him in the future if I get a pre-nup.

I agree. I considered asking for one, but chose not too - but I am certainly not against them.

Just an FYI as soon as you commingle funds, the money becomes both of yours. So let's say you used your savings and you paid for 90% of the house, it would still be 50% his. I know no one wants to think about these things, and you think that even if you get divorced, it will be amicable, but the person you divorce is NOT the same person you marry.

I'm speaking for experience because I couldn't even LIST the many ways my dad screwed my mom (and me) over when he left. He swore up and down initialyl that he would be good and make sure my mom was taken care of and he didn't want anything from her and then he basically made her fight for everything. It was so ugly.

I would sign one and FH would definitely sign one. I think I'm putting one together, but there are going to be stipulations, like if you cheat you get nothing and like it. Things like that.

You do have to be really careful about the stipulations. Believe it or not NY makes it very hard to prove someone has cheated in court. So generally if there is a cheater in the couple, unless it can be proved beyond a reasonable doubt (like the person openly admits it) it can't be used as grounds for a divorce.

I'm not a lawyer by any means but I would definitely look into that more, you might feel it is protecting your assets, by having that stipulation - but it may not cover you fully in reality.

I am definitely not against them. I have seen how messy divorces can get and I think that it is a good, I wouldn't want to leave a relationship in a better position then when I got into it. I would only want to leave with my independence.
