question about mother daughter houses

Our title says that our house has a appartment in it. But there is no appartment in it. At one point there was an appartment but they took it out. They did have a temp permit. Our lawyers are going to take care of it.

My question is Do you think our taxes will go down bc now we have no appartment?

YES they should! Our house has a legal apt in it and it increased our taxes. You should have your house reassessed after the apt issue is cleared up.

What do you mean re-assessed? for taxes?

Thank you so much!

Is the house being taxed as a 2 family? You (or your lawyer) need to look at the tax search that was conducted by the title company to see which rate it is. (A 210 is a single family home in Nassau and Suffolk. In the boroughs it will start with an 'A')

If the property is being incorrectly assessed, you should be able to have it corrected. But you have to bring it to their attention, and they will probably send an inspector/assessor out. The Building Department and the Tax Department do not share this information between each other.

The town estimates how high your taxes should be according to the size of your property, siz of your house, etc. If you have a legal apartment (mother/daughter) situation, the value of your property increases...and so do your taxes.

If you are making it a one family and your attorney is taking care of that for you (I'm assuming your atty is going through the town), you home will no longer be a 2 family house and you will have to have the town reappraise your house. The value will declaine a bit and your taxes should go down.

Your attorney should handle all of this for you. If your taxes don't go down, you can contest it with the town.

We have a legal apartment in our house and because of that, our house is worth more $ and our taxes are a couple thousand higher than our neighbors. We could also sell our home for quite a bit more which is a good thing.

Just keep in mind that most towns are REALLY being strict on issuing permits for apartments/2 family homes. It's next to impossible to get one today. Ifyou have one, you were grandfathered in regardless of what new laws have been passed to restrict new permits from being issued. You might want to consider holding on to the permit if you ever think you might want to rent part of the house out. We have to pay $275 per year for the permit. Just a thought
