Really Bad Morning! Need Help - Big Vent

Really Bad Morning! Need Help - Big Vent

I rent a very large aprtment in a huge house. There is a tennant downstairs who happens to be the landlord's nephew. Last night they had a very loud party & some of his guests got very drunk. Now I am all for a good party, but the reason why we agreed to rent only PART of the house is b/c the other tennant is never home & the landlord promised us it would be very quiet. Since DH woks 6 days & I will be attending Law School next year (hopefuly) quiet is a top priority. So when we woke up this morining - only 5 hours after finally getting to sleep b/c they were so loud - I walk my dog & see the entire front lawn was run over by a car, including $100 worth of lights that DH & I bought for the drive way. I am concerned b/c one of his guests was drunk enough to do this (my driveway is HUGE - it covers 1/4 acre). I am really p-o'd b/c the landscapers fee comes out of OUR rent - not his. The driveway and both yards are ours to use - not his....so when I came home to 6 cars in MY driveway & then this mess this morning DH & I bugged. The tennant told me I was overreacting & he will 'fix' it......

I want to call my landlord & try to get out of my lease.....am I overreacting?

I would definiteley call the landlord. Your landlord probably gets more money for your rent than his nephew and I highly doubt he will appreciate hearing about the disrespect his nephew has for the property. It can't hurt to call. And if he does side with the nephew then I would look into breaking the lease.

I would call him but be careful how 'hot' you get on the phone since it is his nephew. But I would tell him, that you will NOT pay for an increase in the landscaping fee to repair the damage done by his nephews friends. I would also remind the nephew that you have the right to quiet enjoyment of your apartment.

See how the landlord reacts to that, and if he is receptive and talks to the nephew then I would not worry to much, but if he is not receptive at all I would sit down with DH and thing about whether or not you want to live there.

I don't think you are over-reacting - BUT, why should you get out of YOUR lease, and not ask the landlord to force this idiot to leave? If you are comfortable there, why give yourself the stress? Kick the idiot's butt to the curb! JMO.

Call the landlord and make sure his nephew pays for the damage.... if this were anywhere else he would be evicted and make sure you tell your landlord that.

If it continues to happen then try to get out of your lease...

good luck.

You guys are right..... and I really love our place-I don't want to leave. I will take your advice & remind the landlord that this behavior is not acceptable - even if it is his nephew. He should be the one to have to leave. DH just told me that he has 6 people staying at his apartment until Friday (he spoke w/the guy's brother). It is breaking the lease, so I have that to tell him too.

if you like where you are i agree with the other girls i wouldnt leave. i would explain that you took the apartment thinking that you would have quiet and that its totally uncool for him to have parties like that. if he does it again then i would consider leaving if its that bad.

Tough situation here.

I have a question though... why were there lights in the driveway that you went out and paid for if you are just a renter?

I would also be careful what you say to the landlord. As much as you are annoyed... remember that your landlord can make life a living hell for you. Your welcome to ask to get out of your lease because of this. Just make sure you ask in a professional manner.

We put the lights in ourselves b/c they did not require any electrical cable (they are solar) & the landlord was taking forever to do it. I used to bartend & come home very late and DH did not want me coming home in the dark.

If I have any kind of conversation with the landlord I will be super careful. Not only can he make my life a living hell, but the tennant giving me a problem is his family. A very bad situation that I did not find out about until after we moved in.

As I am sitting here writing this at 10pm, his daughter is running through the house screaming & banging on the walls. DH has to get up for work at 5am & is ready to strangle them

Im sorry about that...I agree with everyone else though..talk to the landlord..hopefully he will talk to the nephew and it will never happen again..or kick his as$out!! You shoulodnt have to move though......he should also reimburse you for the lights!!!! Good luck!!!

I wouldn't leave but I would contact your landlord and write a letter. I would bill the landlord for the landscaping and lights too.

I concur. Talk to the landlord.
