Seconds thoughts on taking my husbands last name - help...

We just got married and I told him I was taking his last name. I even had a sweat shirt made with his last name on it following Mrs. which I wore the day of the wedding. When we got our marriage licence, I commited to his last name. I am assuming that on the marriage licence is his last name for me. Now that I am back to reality I think I have changed my mind and want to keep my real last name for a while until I am really ready to change it. When wehave kids I will change it. I just don't see the need now and it is a huge hassle. So my question is... if my name is his name on the marriage certificate and I keep my maiden name on all my credit cards, licence, passport, etc.. for right now, is that ok legally?

I honestly cant see why that would not be legal.

People use maiden names on the cards all the time.......I think it should be perfectly fine.......but then again.....I'm not a lawyer so I dont know for sure.......

I am not really sure, but I don't think it is a problem. As long as your Social security card matches all your other documents i don't think it is a problem legally.

yes that is fine legally!!! I haven't officially changed my name yet and have not had a problem.. I even recently opened a new CC in my 'maiden' name and no problems at all.

eta. Though I think you should talk about it with your DH first. I know mine is very annoyed I have yet to legally change my name.. I am in the process of doing it right now.

I will not be changing anything until January 2006. On the advice of my accountant, if I change my name (thru SSA, etc.) and change my W4 at work when I return from the honeymoon, I will have to file my taxes for 2005 as 'married' and do a joint return despite only being married for 1/4 of the year. My fiance would do the same so we would be hit very very hard with taxes.

I suggest everyone talk to their accountant.

Correct, its the 'marriage penalty'. For us, why change our status on October 1st if it affects the entire tax year of 2005? We weren't married the entire year, why file as if we were. I've been advise to legally change my name and W4 at work as of Jan 1 or 2 or 3, 2006.

I asked my boss who is an accountant and she said the same. Technically, I have to speak w/ my accountant when the time comes........so he can file it single for me for '05, and let the state think I got married in '06, and then my W-4 will change per that info.

Thanks. I feel better now. My husband is said it is my decision but probably would prefer me to change it. I am not doing it till I am ready. I asked him if he would change his to mine or make up a new one and he said no way, so I said then why should I? I think he saw my point.
