small claims court/legal advice...

small claims court/legal advice...

Here's the story...about 3 weeks ago FI rcvd an email from his ex-***** looking for $200 plus interest that FI owed her from a plane ticket. When they broke up (1yr and 1/2 ago) he signed a letter of intent to pay her back with no timeframe. (it was $1000, he already paid $800).
She moved to Texas and now she is looking for the $$. She assessed interest for the 1yr and 1/2 he hasn't been paying. She threatened sueing plus cost for her to fly here if we didn't pay by Oct 25th.
Well, we decided to blow it off. Everyone has told us she is bitter over the engagement, very vindictive and crazy. So, we did. Until yesterday when we get notice from the PO a certified letter from the City Courts.
(Whew) So, saving for a wedding, looking for some free legal advice. Can she collect? Collect interest, legal exp and travel? I am SO po'd. We would just pay her the $200, but I don't want to back down. I know we should just pay the $200 and call it a day but why can't she just move on after all this time?

HA! Sorry LIWeddings...they bleeped out the ex-gf part, except I said something not so nice..sorry Little Elm, TX...know where it is? From what others have told me she's nuts. My Dad once told me there is one type of person you just can't win in a fight with...that's a crazy person. Can you tell he wanted boys?

cynthia, if he signed a letter promising to pay he should regardless of what she is like. Whether she is crazy or not, he is breaking a promise he made. Sorry you have to be in the middle of this. *HUGS*

i know. You are right...it's just hard to swallow. $200 is a plane ticket to Long Island!!! And I guess I'm just bitter she is going throught with this after them being broken up for almost 2 years!!! And FH feels the same way. Either just pay (which, like you said, is probally the right thing) or take this to the end. Let her go through all the aggravation for a lousy $200! aggg, deep down I really know what we have to do. It just bothers me.

I don't mean to be the big meanie here, but she has been waiting over a year to get her money back. I be pretty annoyed too if I was her.

Agree with Valentia...

If he owes her the money, he should pay no matter what the circumstance. And since she had to pay court fees and travel, etc... shes entitled to be reimbursed those expenses too.

ok, HOLD UP LADIES! as i said, i can see both sides. But ease up. First, it was originally a gift from her. The $1000 was for a suit and a plane tix for her sister wedding in FL. They broke up and she demanded the $$. My FI, being a softie, said ok and signed the letter.
And as a small FYI...we were burglarized this past Thursday, a WEEK after she said she wanted her $$. You know what was taken? The DVD player SHE gave him. And someone saw a young guy at our door in the afternoon. Hmmm, kinda sounds like her 22 yr old brother that still lives here.
But I'll let the detectives handle that.
So yeah, caught in the middle. Like I said, deep down I know what has to be done...but gimme a break with the 'teach a lesson comments'....

Re: small claims court/legal advice...

I dont think this is your fault at all! But I do think that if you owe a debt to someone you should pay ASAP. His girlfriend has waited over a year for this money and there really is no excuse not to pay. Whether or not this money should have been paid back to her may be in dispute now but he agreed to pay it back.

Of course, her brother breaking into your house is terrible! But I dont see the tit for tat there. His ex may be trash who is hung up on your FH and is just bitter - but that doesnt mitigate the debt owed to her.

In the end, if he is required to pay the $200 + fees + travel AND lost his DVD player over it, its going to be a tough lesson to learn but perhaps invaluable.

um, yeah. I agree to pay debts back ASAP...and it's not like she has been waiting for this $$. As I said, it's been over a year and a half and no mention of it at all!!??? All of a sudden a letter and court order for the remaining $200. c'mon. And yes the trash, as you so nicely put it, will get her $$.
But the lesson learned here? Hmm, lemme think about that one...don't deal with ex-psyco-chicks, make sure all my doors and deadbolted when I leave for the day....oh, I get it...makes sure fiancee doesn't have any outstanding debts. Thanks so much for pointing out the invaluable lesson.

Re: small claims court/legal advice...

Im sorry I offended you. I didnt mean it was a lesson for YOU, I meant it was a lesson for him. If your home was robbed because of this - then that is terrible and inexcuseable.

You are understandbly upset about this - but it just seems like you are making excuses for why your FH should not pay back this money that is owed. I understand that you dont want to give up the $200 but that does not give your FH not to pay. Just because your Fhs ex didnt bother you constantly for the $$, doesnt mean she wasnt waiting for it. Your FHs ex must have felt that legal action was her last resort.

The key point was that your FH will be saving himself money by paying the original debt. If she wins in court, he is going to have to pay additional fees.

Again - Im sorry I offended you. That was not my intention and please accept my apology.

lesson for him, lesson for me. Whatever. He put a ring on my finger and there is no me/him anymore. This is our problem and we are dealing with it together.
And I'm sorry, I'm not going to boo-hoo, poor her, over his ex needing/wanting this $$ back. So easy to make opinions when you are not in the situation. And I know, deep down, what we have to do to get her out of our lives once and for all. Buck up.
Offend? yes. Apology accepted? yes.
