We saw a great house tonight but it does not have a C.O. for the bathroom in the basement. We would have to apply for the CO if we got the house. How much would taxes go up for a bathroom? It is a full bath with shower but no tub. The real estate agent said about $200 to $300 a year, is that a true ballpark?

I could be wrong but I thought the sellers had to have all the COs before you could close?

See that is what I thought as well, but the agent said we would apply for it. Later on the side, my FH said the same thing you did that the owner should do all of that. I am going to have to ask again tomorrow.

That's not true. The seller is responsible for the C/O don't let the realtor blow smoke up your butt. Remember they work for the seller not you. However You can get it on your own after but why whould you. its gonna cost you more money and it could actually cause problems with you getting a mortgage. We almost got a house in S. Huntington that had this same issue and everyone we talked about told us this even our atty.

Don't listen to the realtor. You (or your atty) should definately bring that up as an issue with them (or their attorney). What if they didn't do it correctly and it's not up to code! Then you'll get stuck not just paying for the CO but also to possibly tear it down or bring to code. That would be a big headache!

I agree 1000% - make the sellers get the CO!

Thanks so much everyone. I am going to tell the agent that the seller gets it or we wont even bother bidding on it. Good point about it not even being installed properly, I never even though of that.
You guys rock.

I wouldn't mention it till they accept an offer from you then you can use it a edge. If you tell them before they probably won't accept your offer.

How can the title company be ok with closing without having the CO? Realtors can be so clueless. It is definitely the seller's responsibility. You don't want to have the burden - as someone above mentioned- if it turns out that the bathroom isn't up to code, it could be costly and timely to get everything in order.
You can still make your offer on the house. You can make it contingent on seller getting all necessary COs. Usually that's part of a standard contract. Check with your attorney.

Similar thing happened to us. They had all the paperwork except for a bathroom they added. We could've insisted, but there were other offers on the house and we really wanted it. We decided to look past it, we had the engineer look at the house and the bathroom seemed fine. YOu don't actually have to apply for the CO. It's really up to you. It wont' be an issue til you sell and then it will be similar situation. If the buyer demands that you have it then you apply for it or make arrangements with them that they'll apply for it.

Re: Taxes going up for extra bathroom?
We bought our house with a CO outstanding. We just signed something that said we were aware of it and would take care of it within 30 days of closing. We were buying from DH's parents, so it wasn't a big deal to us, we knew if it was expensive they would pay.
My girlfriend bought her house without 2 COs and had something in her contract that she would take care of getting the COs, but anything that wasn't to code or that had to be repaired, if plans had to be drawn up, etc to get the COs would be reimbured by the prior owner.
